5 Million Dollar Bribery Scandal: Kano Government Reacts To Video Showing Gov Ganduje Allegedly Receiving Dollar Bribe

Posted: 15 Oct 2018 05:31 PM PDT

Governor Abdullahi Ganduje

The Kano State government has declared that the video showing Governor Abdullahi Ganduje allegedly collecting stacks of dollars in bribe was doctored.

Commissioner for Information in the state, Muhammad Garba, said this in a rejoinder issued Sunday evening.

The state government held a similar position some days ago after news broke that the video would soon be in circulation.

"We wish to state that there is no iota of truth to these allegations and if indeed there is any such alleged video, it is at best cloned," it had said.

The video trending on social media has got many Nigerians talking especially at a time the Buhari government has slammed a travel ban on some Nigerians accused of corruption.

DAILY POST was informed that President Muhammadu Buhari had viewed the clip and ordered two security agencies to open an investigation.

But, according to Garba, the video was "cloned, doctored, disjointed" and that it was deliberately released to "affect the anticipated quantum of APC votes from Kano in 2019".

He said: "Kano state government has decided to file a criminal case against an online publication Daily Nigerian and its publisher on defamation of character after it released a clone and doctored video footage mischievously portraying Governor Abdullahi Umar Ganduje involved in an inappropriate conduct.

"The Office of the Attorney General and Commissioner for Justice is challenging the implausible and eccentric posting of the cloned video that went viral in a court of law considering the gravity of the caricature, which indicates the extent to which mischievous elements can go to discredit public figures by wielding non-existent scandals against them.

"A mere observation of the cloned video clearly shows that the video is doctored and disjointed with no material facts or evidence to prove the allegations, other than a callous attempt to tarnish the hard earned image of the office and the person of the Governor.

"The Governor of Kano State wishes to once again emphatically debunk the allegation of receiving gratification of $5Million or any amount whatsoever from any person or body.

"It is important to draw the attention of the general public to the fact that the alleger is a serial blackmailer and extorter.

"We are also aware that the hidden motive is to reduce the popularity of the Governor and consequently affect the anticipated quantum of APC votes from Kano in the 2019 general elections.

"While the state government is taking the legal action, we wish to assure the good people of Kano that His Excellency will remain focus and continue with laudable programmes that will add value to the lives of the people of Kano State.

"We also call on the general public, especially members of the APC to remain calm and always be law abiding."

What Would You Rather Condone Between Corruption And Incompetence?

Posted: 15 Oct 2018 04:57 PM PDT

NIGERIA

I was asked this critical question last week, and the understanding I got is what I am sharing here.

POINT 1: Both corruption and incompetence are economic disasters with different types of handling. One is like FAMINE while one is like FLOOD with both of them causing serious socio-economic havoc. Give your car to an incompetent mechanic and he will mess it up because he is not intelligent on the job. Give it to a corrupt one and he will install fake parts and still mess up your car in the process, because though he is intelligent on the job, he is crooked in his ways. It takes a measure of intelligence to be a cheat. Corruption and incompetence are two sides of the same coin. With corruption a system slow paces and with incompetence a system stagnates.

POINT 2: If corruption exists in a system, and to curb it you employ an honest but incompetent person to tackle it, then you are only tackling the MODE of the existing corruption and not the corruption itself. It's like a lady wearing transparent silk material and in checking her indecent dressing she was given a lace dress with large holes. Then her indecent dressing has only been modified not curbed. Incompetence can only transform corruption. If you employ an honest teacher to manage a bank because the competent banker is corrupt; the ignorance of the teacher in the banking service despite his honesty and integrity will only modify corruption in the bank and wreck the bank faster. Late Dr. Tai Solarin comes to mind; he was an educator and an activist but was made the Chairman of People's Bank of Nigeria in the 80s by President Ibrahim Babangida because of his integrity. What happened to People's Bank? It collapsed and ruined people's investment due to modified corruption under an honest but incompetent man for the job – with all due respect to him. It takes more of intelligence, divine wisdom and diplomacy with job competence than integrity and honesty to fight corruption. Though corruption is a crooked way of life, it is an intelligent practice.

In the first place, what births and fosters corruption in any system is incompetence of those managing the system. An incompetent administration may shut the door against corruption; it will only create windows without burglaries for it. Nothing really gets to change than its mode of operation - corruption now has to go through the windows and not the door. Incompetence can only modify not eradicate corruption.

Point 3: Where a nation is under the administration of honest but incompetent leadership, progress is arrested and the nation retrogresses for poor job and social intelligence on the part of the leadership. So to manage this situation, the only solution is change of the leadership. Integrity is very crucial but it cannot make up for competence.

Where the system is corrupt, progress is slowed down not arrested. It points largely that the people have intelligent but crooked minds. So to manage it, enforce severe discipline, make scape goats but also reward changed attitude and create enabling environment for positive and rewarding productivity, and you will see the same crooked intelligence that promoted corruption straightened out for positive productivity.

I will not condone any of the two really, because an incompetent leader leads a CLUELESS administration and a corrupt one leads a CROOKED administration. But I think that there is a possibility of progress with a corrupt system than with an incompetent one. Integrity has its place and competence has its place, but you will not settle for an honest truck driver in place of a corrupt but competent pilot to fly your plane when you must fly except you want to fly beyond.

How blessed will a nation be if it's lead by honest and competent men. Such a nation, even if it does not have any natural resources will still thrive economically and blossom. No nation can thrive beyond the thinking of its people. It is more of human resources than natural resources that make a great nation.

Good morning,

Peju Akinwande

Watch Another Video Footage Of Ganguje, Kano Governor Collecting Bribe In Dollars Released

Posted: 15 Oct 2018 04:12 PM PDT

Gov. Abdullahi Ganduje, Governor of Kano State

Gov. Abdullahi Ganduje, the Governor of Kano State, has appeared in another video clip allegedly receiving a bribe.

As promised by DAILY NIGERIAN,  the first video footage  was released to the public on Sunday.

The money was part of tranches received amounting to about $5million from contractors in the state.

Contractors told DAILY NIGERIAN that the governor personally receives from 15 to 25 percent kickbacks for every project executed in the state.

The sting operation to capture the governor on camera began two years ago when one of the contractors agreed to plant spy camera on his kaftan lapel while offering the bribe.

After about 10 months efforts to capture the bribe giving/taking scenes, the governor's face and body were clearly captured in nine clips, while six others did not clearly reveal the governor's face.

Watch video below:

About $5m dollars were allegedly delivered to the governor in all.

One of the contractors who preferred not to be named said the reason he released the footage is to expose corruption and bring sanity to the country.

"If my aim is to blackmail or extort the governor, I would have used the videos, get over a billion settlement or force the governor to pay the hundreds of millions of naira the state is owing my company or force him to pay back all the money I paid him as kickbacks," he said.

"We believe if public office holders are exposed, there will be sanity in the system even if I will not be the beneficiary in future."

Buhari Travel Ban: APC Ex-Spokesman Frank Releases ‘Authentic List’ Of Affected People

Posted: 15 Oct 2018 03:21 PM PDT

Comrade Timi Frank

Former Deputy National Publicity Secretary of the All Progressives Congress (APC), Comrade Timi Frank, has claimed that he had "authentic list" of those who have been banned from travelling abroad as a result of corruption charges preferred against them by the Buhari government.

Frank said the current list of purported 50 high profile Nigerians "to be dealt with" with the coming into effect of the Executive Order 6 (EO6), is a ruse by the presidency to deflect attention from their real motive which is to clamp down on perceived enemies of Buhari and major opposition figures ahead of the 2019 general elections, DAILY POST reports.

Frank in a statement in Abuja on Monday said: "Sequel to my earlier statement, I have now uncovered the true identities of Nigerians being targeted by the President Muhammadu Buhari's administration for punitive measures through the EO6.

"The list below is an updated version of the one I earlier released on Sunday. Information available to me from authoritative channels in the presidency shows that the list earlier circulated by the presidency is fraudulent as it contains names of both Peoples Democratic Party (PDP) and some members of the ruling All Progressives Congress (APC)," he said.

According to Frank, those the presidency "plans to deal with" through the EO6 include; Chief Olusegun Obasanjo, General Ibrahim Babangida, General Abdulsalami Abubakar, Dr. Goodluck Jonathan, Alhaji Atiku Abubakar, General Aliyu Gusau, Senator David Mark, Senator Abubakar Bukola Saraki, Rt. Hon. Yakubu Dogara, Senator Ike Ekweremadu, Governor Nyesom Wike, Governor Waziri Aminu Tambuwal, Governor Ibrahim Dakwambo, Governor Udom Emmanuel, Governor Ayo Fayose, Prince Uche Secondus, Chief Femi Fani-Kayode and Chief Olisa Metuh.

Others are Alhaji Attahiru Bafarawa, Alhaji Kawu Baraje, Sule Lamido, Otunba Gbenga Daniel, Senator Rabiu Kwankwanso, Senator Dino Melaye, Senator Ben Murray-Bruce, Senator Isa Misau, Senator Bala Mohammed, Mrs. Patience Jonathan, Mrs. Toyin Saraki, Amb Goodnews Igali, Tunde Ayeni, Bishop David Oyedepo, Rev Father Matthew Hassan Kukah, Sheik Abubakar Gumi, Chief Raymond Dokpesi, Mr. Jide Omokore, Chief Jonah Jang, Elder Godsday Orubebe, Mrs. Oby Ezekwesili, Mr. Steve Oronsanya, Dr. Muazu Babangida Aliyu, Ibrahim Shema, Senator Esther Nemadi Usman, Bashir Yaguda, Dr. Abba Moro, Amudu Fintiri, Alex Badeh, Warapamo Dudafa, General Azubuike Ihejirika and General Kenneth Minimah.

He said: "It is now clear that the president plans to suspend the constitution which guarantees freedom of association to Nigerians and the right to own property. The plan to deal with opposition figures listed above is real and Nigerians and the international community need to face reality.

"With the present mindset and attitude of the Buhari's administration to retain power at all cost in 2019, I fear that there may not be 2019 after all because the presidency has taken the first step to muzzle and drive prominent opposition underground or clamp them into jail in the guise of fighting corruption.

"I hereby call on Nigerians of conscience and members of the international community, to do something urgently to prevent the eclipse of democracy in Nigeria with impunity and lawlessness by the present administration.

"Our democracy faces a certain peril from the current desperate administration that plans to appropriate the presidency by force since they are now aware that Nigerians have rejected them and will definitely vote them out in 2019."

Let Us Try Atiku If He Fails To Perform, We Will Send Him Packing too - Reformed APC Chairman

Posted: 15 Oct 2018 02:54 PM PDT

Alhaji Buba Galadima, R-APC Chairman
- The R-APC national chairman, Galadima, has endorsed Atiku for president in 2019

- Galadima urged Nigerians to give the PDP presidential candidate a chance

- He added that Atiku will also be voted out if he fails to deliver within four years

The national chairman of the Reformed All Progressives Congress (R-APC), Alhaji Buba Galadima, on Saturday, October 13, urged Nigerians to cast their votes for the Peoples Democratic Party (PDP)'s presidential candidate, Alhaji Atiku Abubakar in 2019 general elections.

Galadima, who stated this in Abuja, while delivering his speech at the official inauguration of Enyimba Progressive Association (EPA), Abuja Chapter, said what annoyed him about President Muhammadu Buhari's administration was its inability to secure lives of Nigerians and their property, Nigerian Tribune reports.

He said: "What we need in Nigeria is the person that can protect you, protect lives and property of individuals and we should keep on changing leaders, we should keep on changing them until we get the best. Buhari is bad, all of you should decide and tell him to go. Let us try Atiku if he doesn't perform, we will send him out too.

"Buhari is the worst we can get, Obasanjo has told us that, Obasanjo doesn't like Atiku but he said he is better than Buhari so let us make progress. We must all resolve to work together to become Nigerians whenever we found ourselves in the world, we should be protected by our country.

"My message is that Buhari must go. He just must go, if Atiku comes and performs to our expectations, he can continue but if he doesn't perform to our expectation, he will go too. We should all put our hands together, strengthening ourselves to develop this country."

He said he might tender a public apology on BBC and CNN for asking Nigerians to vote for Buhari, regretting that the president has failed in meeting people's expectations.

"If there is any person that helped promote him (Buhari) from January 2002 till date, I can hardly be number two if I am not number one. Killing is everywhere and you don't take a damn. People are being killed, communities are being wiped out, and disasters are happening, he doesn't give a damn for two and a half years, what kind of leader is that? So, the man is bad, it is not because he is Hausa or Fulani man because the man is bad, Muhammadu Buhari is bad.

"So, he should go and rest why am saying so is that there are lots of Hausa and Fulani people that are being killed or maybe sleeping with hunger, so these hunger, poverty, killings there is no known bound. Let him go and rest."

Earlier, the director-general of the association, Barrister Ihechi, Ike said the painful part of the history was that same greedy, wicked and selfish persons have hijacked the Nigerian state making wealth for themselves by dividing the ever trusting masses on tribal, ethnic, and religious lines.

However, an All Progressive Congress (APC) chieftain in Niger, Mohammed Santuraki, called for vigilance to ensure that the party emerged victorious in the 2019 general elections, Naij reports.

Santuraki, who spoke with the News Agency of Nigeria (NAN) in Suleja on Saturday, October 13, said APC needed to put its house in order to achieve this.

He said that the various disputes that came up in the course of the party's primaries must be quickly resolved for unity.

2019 Presidency: Agbakoba Details Places Buhari Will Lose Election, Reveals Why

Posted: 15 Oct 2018 11:13 AM PDT

Olisa Agbakoba (SAN),

Olisa Agbakoba (SAN), former president of the Nigerian Bar Association (NBA), said yesterday that President Muhammadu Buhari would not win in the South-West, South-East, South-South, North-Central.

According to him, Nigerians, through their votes, will send him back to the core North in 2019 because he has completely lost the goodwill with which he rode to power in 2015.

Agbakoba said Nigeria was now broken politically, strategically, morally, and completely bankrupt, DAILY POST reports.

Speaking with Daily Independent in Lagos, Agbakoba, who is the leader of the Nigerian Intervention Movement (NIM), said based on his performance in the last three and half years, nothing qualified President Buhari to continue for another term in office.

According to him, even the president's wife, Aisha Buhari, was not in support of her husband continuing in office for another term which explained why she criticised the recently concluded primaries of the ruling All Progressives Congress (APC) and also advised Nigerians to vote wisely in 2019.

On the three-pronged promise of the Buhari administration, namely tackling insecurity, revamping the economy, and the war against corruption, Agbakoba said the current administration had not fulfilled any of the promises, insisting that corruption was now rife in the administration.

He said: "I think it misses the point to say that President Buhari is as popular as he was in 2015, because he is not.

"When the PDP ran their presidential primaries, a lot of big Northerners were there; people like Kwankwaso, Lamido, Dankwambo, Tambuwal, Makarfi, and others.

"In any case, President Buhari will not expect to win the North-West and become Nigeria's president because he has taken part in four elections, this will be his fifth.

"The only time he won was when (Bola) Tinubu made the foolish mistake of bringing him to the South. Now, what will happen is that we will send him back to the North. The North alone can't make him president; he has to have national appeal.

"So, I can tell you for free that President Buhari is not going to win the North-Central. He is not going to win the South-West; he is not going to win the South-East, and he is not going to win the South-South. So, I don't know where his votes will come from. If it is going to come from the North-West, that is fine.

"Completely, President Buhari has no goodwill left. All the euphoria that was felt, I didn't feel it because I have always known his background.

"There was a huge euphoria of change that former President Goodluck Jonathan had not done well; that he presided over a highly corrupt government, and Buhari was the Mr. Clean, Mr. Integrity, and he will fix things. But that has not happened.

"On the contrary, Nigeria is broken politically, strategically, morally, and a completely bankrupt country. Poverty level has grown, 85 million Nigerians are extremely poor, we have now become the poverty capital of the world.

"So, the euphoria of 2015 is certainly not the euphoria of 2019, and that is why, personally, I am unable to support his campaign to remain in office.

"To support the campaign to remain in office for me is to look back at what he has done, the campaign promises on corruption, security, and the economy. These are the three big campaign issues, nothing has been fulfilled.

"In spite of all the monies borrowed, we are now pushing to over $30 billion borrowed money unaccountable, infrastructures all in pieces, corruption is rife".

"You remember the case of his SGF, Babachir Lawal; you also remember the case of Abdulrasheed Maina, and so on. So, there is nothing that stands him out as qualified to continue.

"Even Buhari's wife has criticised the primary election that the APC held, so that will tell you that even in the other room in his house, he doesn't have support.

"Why would I be supporting a man whose own wife does not even support him? For me, he is history. I just hope that we can have a new president."

Giving a detailed projection of what may play out in the 2019 presidential election, Agbakoba, who blamed Asiwaju Bola Tinubu, former governor of Lagos State, for forming an alliance with Buhari in 2015, said Buhari contested four times between 2003 and 2011 but couldn't achieve success because he didn't enjoy the support of the South.

Agbakoba, who said former President Olusegun Obasanjo's endorsement carried a lot of weight based on the strong followership he enjoys across the country, said anyone saying Obasanjo was irrelevant as far as the 2019 presidential election was concerned, would be making a huge mistake.

"There is no way he can discountenance the influence of Obasanjo, you will be doing so at your peril because he has a strong followership.

"Obasanjo has strong followership in the South-West, Afenifere is on his side because they all believe in restructuring.

"The South-East cultural, traditional systems are on the side of Atiku because he believes in restructuring. The South-East has felt marginalised and excluded and he (Atiku) now comes and said I will bring you in."

On the chances of Atiku Abubakar, the presidential candidate of the Peoples Democratic Party (PDP) in 2019, Agbakoba said the presidential election was a two-horse race between the APC and PDP and argued that the claim by Buhari's loyalists that Atiku was corrupt did not matter.

He said what mattered was his ability to turn around the fortunes of the country like US President Donald Trump is doing despite the many negative stories about his personality.

"I am not interested in whether he is a thief. Jesus Christ cannot be the president of Nigeria. Donald Trump is not an angel but he is the most effective president in a long time.

"In the United States now, unemployment rates are down, the economy is booming, and everything is working.

"The fact that he has girlfriends and does all those bad things doesn't mean that he is not effective.

"Yes, Atiku may not be an angel but I am not interested in that. I am tired of having a bad government. It is almost like the Jonathan-Buhari thing.

"When people said they were tired of Jonathan and brought in Buhari, so the same way now, people are tired of Buhari, and it is my hope that Atiku, if he does win, will learn lessons and move forward to do the right thing," he said.

JUST IN: ‘Probe Your Wife Over Alleged Missing N2.5b Or Stop Harassing Nigerians’ - Alhaji Suleiman Baba Jada

Posted: 15 Oct 2018 10:51 AM PDT

Mrs Aisha Buhari

Alhaji Suleiman Baba Jada, a public affairs commentator and member of Adamawa Elders Forum,  has asked President Muhammadu Buhari to prove to Nigerians that he is not selective in his anti-corruption war by directing Economic and Financial Crimes commission (EFCC) to probe his wife Aisha Buhari how she got N2.5 billion she accused her ADC SP Baban Inna of diverting.

He told journalists yesterday in Yola, the state capital that the silence of the president over the alleged N2.5b his wife said was diverted by her ADC has raised questions on the integrity of the President and his government.

Jada said it is a confirmation that the anti-corruption war of the government is only targeted at members of opposition parties.

If the President fails to probe his wife over money which no Nigerian knows how she got it, it means that the President is shielding her.

He said that without EFCC inviting Aisha Buhari for investigation, the government would no longer be taken serious on anti-corruption crusade, the GUARDIAN reports.

On the recent criticism of APC by Aisha Buhari over the just concluded All Progressive Congress (APC) primaries, the Adamawa elder faulted the First Lady, saying that she has only crossed her boundary, she has taken over government, party and the responsibilities of her husband as President.

BREAKING: Buhari Must Go, Obasanjo Tells International Community As He Arrives Indonesia

Posted: 15 Oct 2018 10:00 AM PDT

Obasanjo and Buhari

Former Nigerian President Olusegun Obasanjo arrived Bali, Indonesia Friday evening calling the international community to support regime change in the forthcoming presidential elections in 2019.

Obasanjo in January called on President Muhammadu Buhari not to seek re-election in 2019. The rhetorical escalation was backed by new statements endorsing the candidacy of his former deputy, Atiku Abubakar on Wednesday.

"He would be asking friends of Nigeria around the world to join him in calling on President Muhammadu Buhari to face the reality of the complete rejection of his administration by the Nigerian people and to step aside", revealed a top former US official residing in Atlanta. The official who is also in Bali said that they have began notifying allies.

The former president is speaking at an event Saturday at the sidelines of the 2018 Annual Meetings of the International Monetary Fund (IMF) and the World Bank Group.

The Annual Meetings bring together central bankers, ministers of finance and development,
private sector executives, civil society, media and academics to discuss issues of global concern,
including the world economic outlook, global financial stability, poverty eradication, jobs and
growth, economic development, aid effectiveness and climate change.

Meanwhile, the Special Adviser to the President on Media and Publicity, Mr. Femi Adesina, on
Thursday said that no coalition of forces can defeat the president in 2019.

"The harder they come, the harder they fall. 2019 presidential election on my mind," the
presidential spokesman wrote on twitter.

I Have Known Peter Obi Since 1989, He Is Fearless, Honest, Efficient - Chief Joseph Chukwuma Ikunna

Posted: 15 Oct 2018 08:39 AM PDT

Peter Obi

I have known Peter Obi since 1989 when he lived in Church street in Willesden and I lived in Harlsden and worked in Cricklewoon before working in Shepherds Bush, and eventually Nottingham.

By 1997, we were both trading independently at the famous OKE ARIN market, in imported branded food and beverages, where we competed over a few brands, and many times shared suppliers. I'm sure Mike Parnell can remember. Peter was always ahead of me, because he had been in the business before me, and had much more capital. Sometimes I would take over one of his brands that he had lost interest in, as he moved higher and higher. I earned his respect in business, as I was able to make monies out of some products Peter thought were no longer worth it (my overheads were lower). He earned my respect to and till this date, we both have mutual respect for one another. Whenever we meet at occasions it's hugs and kisses.

In 2002, he decided to go into Politics, promising to bring change to Anambra State and he did. When he was rigged out in the 2003 election, we thought it was all over, but Peter did not think so. He took the matter to court at a time when most of us had lost confidence in the Nigerian courts. As God would have it, Ngige reneged on a promise he had made to Chris Ubah, and lost OBJ's protection, hence the courts were told to do the right thing and judge the case on its merits. The case took almost three years and some of us would snigger behind Peter's back, each time he told us he would win the case, but I remember sitting with him Peter in his Apapa office one Thursday afternoon in March 2006, when I went to see him in his capacity as Chairman of Fidelity bank where Peter told me that by tomorrow being a Friday he would get judgment and move on to become the governor of Anambra State. I did not believe it, but he was correct. He got judgment the next day, and by afternoon moved into government house Akwa, just as Ngige was forced to leave. Through Peter's almost eight years as governor of Anambra State, I never bothered him, because I knew it would be a waste of time. He does not believe in cronyism. No one around Peter made much money, because he ran an efficient government in which the people of Anambra State were the sole beneficiaries.

Politics did not change Peter Obi one bit, instead he changed politics. He kept to his values of honesty, efficiency and humility, along with his understanding that everything in life is vanity. He understands from our days of trading that one must stick strictly to agreements, and the more you pay back your credit, the more credit you will get from suppliers, hence his 100% honesty to life and all that he does, just like myself. He is fearless and cannot be bought over.

Atiku therefore chose the best Nigerian possible to guide him in rescuing Nigeria. Peter is the best Nigerian for the job of Vice President by miles. By not consulting with Igbo leaders he made it clear that he was not appointing an Igbo man, but a Nigerian man for the job. He was perfectly within his rights to so, as he has the Presidential ticket and not the igbo leaders. Peter Obi is de-tribalized, does not take bribes and is a none conformist. It is no wonder those Igbo leaders would not be happy with Atiku's choice.

By choosing Peter Obi, it is 100% Clear that Atiku wants to rescue Nigeria. The fact that Peter Obi is of Igbo extraction has no bearing on Atiku's choice. In fact those Igbos that are against it should all go and bury their heads in the sand. Those Igbos rejoicing about his appointment will soon find out that he is a full Nigerian and will in no way advance any Igbo or Igbo cause that is not in line with the total service and security of this country. That's the man Atiku has chosen.

It would appear that at last Nigeria is doing away with tribal politics and doing the right thing. All credit for this appointment should go to Atiku, and is a sign of things to come. It is a sign that Atiku is bent on Changing this country for the good of all. Peter is youthful in mind and thinks deeply about the prospects for our teeming youth. I hope that by next year I will be able to justify my faith in Nigeria when Peter become the Vice President.

Allow The Courts To Impose Travel Ban On Suspected Looters! By Falana

Posted: 15 Oct 2018 07:45 AM PDT

Court

Last week, the Federal High Court upheld the constitutional validity of the controversial Executive Order 6 (EO6) issued by President Mohammed Buhari on July 5 this year.

Based on the court ruling the federal government has directed the Nigeria Immigration Service and other security agencies to place no fewer than 50 high profile persons directly affected by EO6 on watch-list and restrict them from leaving the country pending the final determination of their cases.

Even though the names of the "50 high profile persons" have not been published by the federal government they are presumed to be either standing trial in the various high courts or being investigated for corrupt practices by the anti-graft agencies. Sadly, the travel ban is a sad reminder of the reckless placement of political opponents on security watch list and seizure of their passports by the defunct military junta.

But in Director-General, State Security Service v Olisa Agbakoba (1999) 3 NWLR (Pt 595) 340 the Supreme Court did not hesitate to condemn the violation of the right of the respondent to freedom of movement through the seizure of his passport by the appellant. It was the view of the Court that the right of citizens to freedom of movement guaranteed by section 41 of the Constitution and article 12 of the African Charter on Human and Peoples' Rights (Ratification and Enforcement) Act could not be abridged or abrogated by the Executive outside the procedure permitted by law.

Notwithstanding that the decision was handed down in the heyday of a ruthless military dictatorship the current political dispensation has witnessed the secret imposition of travel ban on many citizens.

Thus, apart from placing over a hundred citizens on security watch list the passports of the late Chief Emeka Ojukwu, Mallam El-Rufai, Dr. Oby Ezekwesili, Mr.Sanusi Lamido Sanusi (now Emir of Kano) etc were seized without any legal justification by the Obasanjo and Jonathan regimes. It is on record that both El Rufai and Sanusi successfully challenged the seizure of their passports at the federal high court which ordered the release of the passports and awarded damages to them.

In one of the proceedings of the Chukwudifu Oputa Panel on human rights abuse, I had complained against the refusal of the State Security Service to remove my name from the watch list compiled by the defunct military junta. in justifying its decision to retain my name on the watch list on the grounds the SSS claimed that every democratic country has a list of persons whose activities are closely monitored at home and abroad for "security reasons"

However, the power of the anti graft agencies and the courts to place criminal suspects on watch list or subject their passports to temporary seizure has never been in doubt. To that extent, the directive to place the 50 high profile suspected persons on watch list and restrict their movement is highly superfluous, completely unwarranted and totally uncalled for, VANGUARD reports.

In fact, it is an ingenious design to expose the Buhari administration to ridicule. If the federal government had done some background check it would have discovered that the names of the 50 VIPs have long been placed on security watch list while their passports have been impounded by the anti graft agencies or the courts as one of the conditions for admitting them to bail. It is public knowledge that whenever the defendants wish to travel abroad for medical treatment they usually apply for the interim release of their passports.

Since the courts have taken judicial notice of the perilous state of medical facilities in the country such applications are usually granted. And once the suspects return from the foreign medical trips their passports are returned to the registry of the trial courts.

No doubt, indigent accused persons standing trial for stealing, fraud or other economic crimes in Nigerian courts are not entitled to such privilege because they have no money to acquire passports not to talk of paying for foreign trips and medical treatment abroad. In Joshua Dariye v Federal Republic of Nigeria (2015) LPELR-24398 (SC) the Supreme Court noted the resort to delay tactics by members of the bourgeoisie standing trial for corruption who usually apply for the release of their passports to enable them to travel abroad for urgent medical attention.

According to their lordships, "There are cases where the accused develop some rare illness which acts up just before the date set for their trial. They jet out of the country to attend to their health and the case is adjourned. If the medical facilities are not available locally to meet their medical needs is because due to corruption in high places the country cannot build proper medical facilities, equipped with the state of the arts gadgets".

Notwithstanding such judicial indictment of politically exposed persons seeking medical treatment during trial the law has not authorised the Executive to restrict the movement of criminal suspects. In February 2009, the federal government regime directed all Nigerian embassies and high commissions not to renew the passports of Messrs Nuhu Ribadu and Nasir El Rufai (now Kaduna state governor) on account of intra class feud. Both of them were then living in exile.

But as soon as the attention of former President Umoru Yaradua was drawn to the case of the Director-General, State Security Service v Olisa Agbakoba (supra) he ensured that the illegal directive was immediately withdrawn. For the umpteenth time, I am compelled to caution the Buhari administration to wage the war against the menace of corruption within the ambit of the rule of law. Since the 50 high profile criminal suspects covered by EO6 have been placed on watch list while their passports have been seized by either the anti graft agencies or the courts the travel ban slammed on them by President Buhari ought to be withdrawn without any delay.

Watch Video Footage Of Ganduje, Kano State Gov, Allegedly Receiving Stacks Of Dollar Bribe

Posted: 15 Oct 2018 04:10 PM PDT

Gov. Abdullahi Ganduje, Governor of Kano State

Gov. Abdullahi Ganduje, the Governor of Kano State, has appeared in a video footage allegedly receiving bribe amounting to about $5million from contractors in the state.

Some Contractors had told DAILY NIGERIAN that the governor personally receives between 15 to 25 per cent kickbacks for every project executed in the state.

The sting operation to capture the governor on camera was said to have began two years ago when one of the contractors agreed to plant spy camera on his kaftan lapel while offering the bribe.

During the about 10-month effort to capture the bribe giving/taking scenes, the governor's face and body were reportedly clearly captured in nine clips, while six others did not clearly reveal the governor's face.

About $5m dollars were said to be delivered to the governor in all.

One of the contractors who preferred not to be named, was reported as saying the reason he released the footage was to expose corruption and bring sanity to the country.

Watch video below:

"If my aim is to blackmail or extort the governor, I would have used the videos to get over a billion settlement or force the governor to pay the hundreds of millions of naira the state is owing my company or force him to pay back all the money I paid him as kickbacks," he said.

"We believe if public office holders are exposed, there will be sanity in the system even if I will not be the beneficiary in future."

The Kano government has however claimed that the video was cloned.

"We wish to state that there is no iota of truth to these allegations and if indeed there is any such alleged video, it is at best cloned," the Kano state commissioner for information, Muhammad Garba, said in a statement.

"The government of Kano state is taking this matter seriously, and will exploit every appropriate and legal avenue to ensure that it gets to the root of the matter and the perpetrators are brought to book."
