Nigerian rapper, MI has accused American rapper J.Cole of stealing his style for his new song "Middle Child" which dropped few days ago.


While replying a Twitter user who brought it to his attention, comparing it to his 'Head of the family' in his 'Illegal Music 2' mixtape, the Nigerian rapper wrote: 'SMH.. n***as been biting my style for years.'


Jermaine Lamarr Cole, known professionally as J. Cole, is an American rapper, singer, songwriter and record producer. Born on a military base in Germany but raised in Fayetteville, North Carolina, Cole initially gained recognition as a rapper following the release of his debut mixtape, The Come Up, in early 2007

Two corpses found near police checkpoint

Two lifeless bodies were on Friday discovered in a forest at a police checkpoint between Enugu and Ebonyi states by stranded passengers held up by a clash between policemen and a lorry driver.

A driver of a lorry fully loaded with yam was stopped at the checkpoint by policemen on duty and the driver allegedly gave them N500, which was reportedly rejected by the policemen.

It was gathered the policemen had requested for N1,000 which the driver said he could not pay.

Trouble was said to have started when the driver resisted the policemen from deflating his tires and the driver was beaten to pulp which warranted other drivers to block the road for over two hours.

It was in the process that some stranded passengers who went to defecate saw lifeless bodies in the bush.

This infuriated road users who alleged it was the police that killed and dumped the corpses in the bush.
A source, who craved anonymity, said: "What I saw was that a driver of lorry fully loaded with yam was stopped by the policemen at checkpoint and he gave them N500 and the policemen rejected the money.

"The policemen approached the driver when he told them that since he had given them N500 which the policemen rejected, that none of them can deflate his tire.

"Trouble started when the policemen attempted to deflate his tire. When he tried to stop them, they started beating him.

"The driver was almost killed. It was at this point that other drivers with articulated vehicles blocked the road causing hold up for hours along the Abakaliki-Enugu Expressway.

"As the road was blocked, stranded passengers and other drivers who were pressed entered the bush to defecate and they saw two lifeless bodies.

"I left Enugu so early this morning as at 6am, but I was there till 8am this morning.

"The dead bodies were found around the police checkpoints. The people around were suspecting it was the police that killed them.

"They were surprised why the dead bodies should be found around the checkpoint.

"That is why the people were accusing them. I was there when it was happening. Nobody told me about it."

The Nation could not independently confirm the allegations against the Police as at press time.

Police spokesman in the state, Lodah Loveth, said she was yet to be officially briefed on the matter.

Court uphold Ogah as Abia APC governorship candidate

A Federal High Court in Abuja on Friday held that Uche Ogah was the validly nominated candidate of the All Progressives Congress (APC) for the next governorship election in Abia State.

Justice Anwuli Chikere, in a judgment in the suit by Ogah, held that, by the provision of Section 87 of the Electoral Act, it was the National Working Committee (NWC) of a party that can conduct a valid governorship primary.
Justice Chikere further held that since Ogah emerged from the primary held by the APC's NWC, he is a product of a valid primary.

The judge proceeded to void the primary conducted by the Abia State Executive of the APC, from which Ikechi Emenike was said to have emerged.

Justice Chikere barred the Independent National Electoral Commission (INEC) from substituting Ogah's name with any alternative provided by the APC.

Court okays INEC’s rejection of Zamfara APC’s candidates

A Federal High Court in Abuja has held the Independent National Electoral Commission (INEC) acted within its powers by refusing to accept list of candidates for the next general elections from the Zamfara State chapter of the All Progressives Congress (APC).

Justice Ijeoma Ojukwu said it was not the fault of INEC that the APC failed to conduct a valid primary within the period scheduled by the electoral body.

Justice Onjukwu said INEC's action was intended to curb impunity among political parties and politicians; ensure that rule of law is adhered to.

The judgment was on a suit, marked: FHC/ABJ/CS/1279/2018, filed in the name of APC by some individuals, who said they emerged from a consensus arrangement adopted by the party in Zamfara State.

Justice Ojukwu, who dismissed the case for being without merit, noted that evidence presented before the court by parties did not show that the APC conducted its primaries within INEC's published schedule of activities, which required parties to conduct their primaries and submit list of candidates within August 18 and October 7, 2018

The judge said the decision of the APC in Zamfara to select its candidates through a consensus option, breached the provision of the Electoral Act and the party's constitution.

Justice Ojukwu said, by the fact before the court, it could not be held that INEC acted ultra vires by rejecting Zamfara APC's candidates' list.

The judge added that INEC's decision was to deter impunity and ensure that the right thing was done and the provisions of the law complied with by political parties.

She said: "The intendment of the law is that due process must be followed. The 1st defendant's (INEC's) action was to ensure that the party complies with rule of law."

The judge said it was obvious that, as at the close of nomination for the 2019 elections, according to INEC guideline, the party (APC) had no candidates, having failed to conduct legitimate primary.

Earlier, Justice Ojukwu dismissed the preliminary objection brought against the suit and held that there was no similarity between the case before her court and the one pending before the High Court of Justice, Zamfara State, marked: ZMS/GS/52/2018 filed on December 6, 2018by Alhaji Babandida Abdullahi, Chairman, APC, Gusau Local Government and others against the APC and others.

While Justice Ojukwu was delivering judgment in the case in Abuja, Justice Muhammad Bello Shinkafi of Court 3, High of Zamfara State in Gusau, also rendered judgment in the suit by Alhaji Abdullahi and held that the APC actually has candidates having conducted valid primaries between October 3 and 7, 2018.

Justice Shinkafi proceeded to order INEC to accept the candidates produced by the primaries as APC candidates in Zamfara for all positions in the forthcoming general elections.
A certified-true-copy (CTC) of the judgment certificate signed by an Alhaji Lawali Sanda Kaura (Assitant Director), sighted by The Nation on Friday, indicated that the court granted all the prayers by the plaintiffs.

It reads in part: "Now, on the strength of evidence adduced by the plaintiff, the evidence elicited from both DWS1 and 2 during cross-examination, as well as the documentary evidence tendered and admitted in evidence, I am satisfied that the plaintiffs have proved their case against the defendants.

"Consequently therefore, the above issue for determination formulating is hereby. Answered in the affirmative and all the reliefs claimed by the plaintiffs are hereby granted.

"An order declaring as lawful and valid the primary election conducted by the APC (herein plaintiffs' party) under the supervision of the 3rd defendant (INEC) and security agents on the 3rd and 7th October 2018 for the purpose of producing candidates to vie for various offices, which produce the plaintiffs, under the platform of the 1st defendant." The court also order INEC to "accept and accord due recognition to the list of the candidate that emerged as winners" in the primaries of the 3rd and 7th October 2018

The court also ordered the 1st defendant (APC) to "recognise and accept the list of candidates that emerged as winners" in the primaries.

The court further granted a perpetual order of injunction restraining the defendants and their agents "from taking any steps towards cancelling/rejecting the result of the primary election held on the 3rd and 7th of October 2018 and monitored by the 3rd defendant."

Lawyer to the plaintiff in the Zamfara case, Mahmud Magaji (SAN) said, with the judgment of January 25 given in his clients' favour, INEC cannot afford not to accepts the list of candidates that emerged from the primaries that the court has said were valid.

APC says Atiku’s endorsement dubious, misleading

The All Progressives Congress (APC) described as "dubious and misleading'', the recent endorsement of Alhaji Abubakar Atiku of Peoples Democratic Party (PDP) by Ohaneze Ndigbo.

Malam Lanre Issa-Onilu said on Friday in Abuja at a news briefing while reacting to the development, which he said was a miss representation of the interest of Ndigbo.

The APC spokesman, however, said that the purported endorsement may have been done by Atiku's friends whom he had publicly promised to make rich if he became the country's president.

He added that Ndigbo should beware of PDP, and Atiku's restructuring deceit.

"We find it curious that the presidential candidate of the PDP has tactically avoided speaking on his touted restructuring plans during his campaigns.

"Our observation comes against the backdrop of the now disputed communique issued by some members of Ohaneze Ndigbo on the 2019 general elections.

"With a few members of Ohaneze falling for Atiku's antics, it has now become clear that the purported endorsement of Atiku's presidential ambition does not enjoy the support of most of the Igbos.

"One of such proofs is the statement by the Anambra Government's dissociating the state from the dubious endorsement of Atiku contained in the equally disputed communique," he said.

He added that with the development, it was obvious that few people in Ohaneze were trying to misrepresent the interest of the Ndigbo.

He wondered whether these people were part of Atiku's friends whom he promised to make rich if he became the country's next president.

Issa-Onilu added that besides Atiku's deceitful restructuring promise, the Igbo people had nothing else to gain from his presidency.

He further added that under the President Muhammadu Buhari APC-led administration, 69 verifiable projects had been commissioned, saying that while some were on-going, others had been completed.

Issa-Onilu said the situation would only get better under an APC- led administration.

"About 69 verifiable road and bridge projects are on-going in the South-East, this is unprecedented in the history of our nation.

"Although the contracts for many of the roads were awarded by past PDP administrations, they were either poorly funded or not funded at all, hence work on the road and bridge projects were previously stalled.

"Currently, the roads and bridges, which are spread across the five states in the South-East, are in different stages of completion.

"Thanks to the funding sourced by the President Buhari-led APC administration from budgetary allocations, the SUKUK Bond and the Presidential Infrastructure Development Fund," he said.

Endorsement: Anambra disowns Ohaneze, APC says dubious

The Anambra government has disassociated itself from the communiqué by Ohaneze Ndigbo endorsing the candidacy of Alhaji Atiku Abubakar  an endorsement described as "dubious'' and "misleading" by APC.

Abubakar is the People's Democratic Party (PDP)'s presidential candidate in the February 16 election.

Prof. Solo Chukwulobelu, the Secretary to Anambra Government (SSG), made the disclosure in a statement made available to newsmen in Enugu.

Chukwulobelu declared that the contents of the communiqué did not reflect the Anambra Government's position.

It will be recalled that an arm of the Ohaneze Ndigbo 'Ime Obi' arising from a meeting on Thursday in Enugu declared support for Abubakar.

Ime Obi is like a rapid response arm of the Ohaneze Ndigbo, comprising delegations from the seven states that make up the organisation including state governors.

However, Chukwulobelu expressed dismay that the apex Igbo socio-cultural organisation had decided to be partisan, in spite of the fact that members of the organisation belong to different political parties.

Chukwulobelu said: "We have read bits of the communiqué purportedly issued by the Ohaneze leadership. We regret that they do not reflect the position of the people and Government of Anambra State.

"The position of the Anambra State Government is that Ohaneze should remain a united umbrella for all Ndigbo, and should not take sides with any party.

"There are major leaders in all political parties, including the three major ones in Nigeria, namely, All Progressives Grand Alliance (APGA), All Progressives Congress ( APC) and PDP.

"It is deeply regrettable that the Ohaneze leadership has chosen to go down a divisive trajectory capable of setting back Igbo unity for several years," he said.

The SSG said that Gov. Willie Obiano had sent a delegation to attend the Ime Obi meeting summoned by the organisation in Enugu.

"Our delegation arrived early enough to participate in the meeting of Ime Obi scheduled to start at 7 p.m. on Thursday.

"We were surprised to learn that the meeting had been held earlier and lasted for a mere 30 minutes.

"The representative of the Ebonyi State Government, Dr Eric Kelechi Igwe, who arrived at the venue before the time the meeting was scheduled to start was also surprised that it had already taken place.

"The same goes for others like the Minister of Science and Technology, Dr Ogbonnaya Onu, and the Minister of Labour and Employment, Dr Chris Ngige," he said.

Chukwulobelu said that they were shocked that the meeting was even slated for a day President Muhammadu Buhari was campaigning in Anambra and Enugu States.

He said that Buhari's visit to Anambra was to honour Dr Nnamdi Azikiwe, First Republic President of Nigeria, and the leadership of Ohaneze Ndigbo was expected to participate actively.

"We were, indeed, surprised that the Ime Obi meeting could hold today (on Thursday) of all days.

''We had expected Ohaneze leaders to participate actively in the inauguration of the Zik Mausoleum, Onitsha, Anambra State," he said.

Chukwulobelu said that the Mausoleum which had been under construction for the past 23 years was completed by the Buhari's Administration which was a big honour to Azikiwe, an Igbo man.

Meanwhile, the All Progressives Congress (APC) has described the as dubious and miss-leading.

There seems to be trouble brewing between Nollywood actor, Lola Alao and Victor Ibrahim, the estranged spouse of late actress Aisha Abimbola over the custody of their two kids. The actress, who battled cancer before her death on Tuesday May 15, 2018, was laid to rest on May 17, 2018 in Canada.



Though Lola Alao has been taking care of the kids since Aisha's death, the eventual custody of these kids is already being determined in a court in Canada.

According to Enquirermag close sources, there's tension between the late actress' family and now Canada-based Lola Alao over the rightful custodian of these kids.

The fate of Keji and Lase (the kids) is in the court of law already. Even though, Lola Alao, the late actress' bosom friend and Victor Ibrahim, the estranged father of the kids are not ready to divulge any information regarding the civil suit which we gathered has been adjourned till January 29th, 2019 for final judgment, there is reportedly a power tussle on the children's custody.

Though, the fact that, actress Lola Alao was considered as the next-of-kin to the late Omoge Campus when she was dying is not in contention, she (Lola) was the only one that was around taking responsibility of the ailing actress and it was also gathered that, Omoge Campus had no other choice than to ask her friend, Lola for that favour of taking charge of her kids if she eventually died.

Now, months after her death, the Canadian authority had invited family members via a letter directly addressed to the father of the kids who's in Nigeria.

The letter requests for him to agree if the children's custody should be given to Lola Alao who has been acting as their guardian.

As it is, the father of the kids has refused to give consent even though he hasn't been fraternising with the kids.

Enquirermag was informed that the father of the kids is also seeking to also benefit from such opportunity, more so, now that those kids are Canadian citizens.

The duo of Lola Alao, and Victor Ibrahim Enquirermag gathered are said to be weighing different options available because, according to inside sources, the kids' father is said to have been tipped on what Lola Alao has been benefitting, in form of allowance from the government for having the kids' custody.

In our facts-finding mission, Enquirermag got in touch with the actress, Lola Alao in Canada and in one breath, she denied anything of such and when we probed further she said, "Look, it's even me that informed Victor of the letter from the government, there's no fight anywhere. I also have my own kids, I am just helping a late friend, I have nothing to hide, where did you guys get all these fake news, I am not aware of any court issue and as we speak, the kids are holidaying with one of their father's relatives here in Canada, if anyone writes any useless story about me, I will be ready to sue the person."

And on his part, the father of the kids flared up when we contacted him on his phone.
He said, "Where did you hear all these? I don't want to speak on this. It's a family issue and has nothing to do with the press. Please you guys should not compound this case for me."

CJN: Justice Mohammed replaces Onnoghen

President Muhammadu Buhari has sworn-in Justice Ibrahim Tanko Mohammed as the Acting Chief Justice of Nigeria (CJN).

Justice Mohammed's appointment follows the suspension of the incumbent, Justice Walter Onnoghen.

Onnoghen is currently facing charges bordering on non-declaration of some of his assets, especially accounts of foreign currencies.

65-year-old Justice Muhammad, from Bauchi state, is the most senior justice of Supreme Court of Nigeria.

He attended Government Secondary School, Azare where he obtained the West Africa School Certificate in 1973 before he proceeded to Ahmadu Bello University where he received a bachelor's degree in Law in 1980.

He later obtained a Master and Doctorate (Ph. D) degrees from the same university in 1984 and 1998 respectively.

Case against Onnoghen

The Code of Conduct Tribunal (CCT) had scheduled Monday Jan. 14 for the arraignment of Onnoghen, on allegations of false and non- asset declarations.

Mr Ibraheem Al-Hassan, the tribunal's Head, Press and Public Relations, has said the action was consequent upon an application filed by the Code of Conduct Bureau (CCB) to the chairman of the tribunal.

Al-Hassan said the application was signed by Mr Ibrahim Usman and Mrs Fatima Ali on behalf of the bureau.

He said the tribunal would commence the trial of the CJN on six-count charge as the service of summons had been effected on the defendant.

The News Agency of Nigeria (NAN) reports that the Anti-Corruption and Research Based Data Initiative (ARDI) filed the petition at the Code of Conduct (CCB) against Justice Onnoghen.

Mr Dennis Aghanya, Executive-Secretary of the organization, who made the copy of the petition available to NAN on Saturday in Abuja, said the body had acted as a whistleblower.

Aghanya said the petition, which was filed on Jan. 7, was an offshoot of a painstaking investigation into the dealings of the CJN.

He said the organisation was of the strong opinion that the allegations were weighty enough to compel an action against Justice Onnoghen.

The petition reads in parts: "we hereby petition you on suspected violations of the law and the Constitution of Nigeria by the Honourable Mr. Justice Walter Samuel Nkanu Onnoghen, the Chief Justice of Nigeria.

" Specifically, we petition you based on the alarming facts detailed below, all of which indicate that the leader of our country's judicial branch is embroiled in suspected official corruption, financial crimes and breaches of the Code of Conduct Bureau and Tribunal Act.

"The particulars of our findings indicate that: His Lordship Justice Walter Onnoghen is the owner of sundry accounts primarily funded through cash deposits made by himself, up to as recently as 10th August 2016.

"These appear to have been run in a manner inconsistent with financial transparency and the code of conduct for public officials.''

The body had alleged that Justice Onnoghen made five different cash deposits of 10,000 dollars each on March 8, 2011 into Standard Chartered Bank Account 1062650.

The group also alleged that the CJN on June 7, 2011, made two separate cash deposits of 5000 dollars each.

It was also alleged that the June 7, 2011 transactions were followed by another four cash deposits of 10,000 dollars each.

Similarly, ARDI further alleged that Justice Onnoghen had on June 27, 2011, made another set of five separate cash deposits of 10,000 dollars each and made four more cash deposits of 10,000 dollars on June 28, 2011.

The body alleged that the CJN had also failed to declare his assets immediately after taking office, adding that the inaction was contrary to Section 15 (1) of Code of Conduct Bureau and Tribunal Act.

ARDI also alleged that Onnoghen did not comply with the constitutional requirement for public servants to declare their assets every four years during their career.

The group alleged that the Code of Conduct Bureau Forms (Form CCB 1) belonging to Justice Onnoghen for 2014 and 2016 were dated and filed on the same day.

The group alleged that the acknowledgement slip for Declarant SCN: 000014 was issued on Dec.14, 2016 while that for Declarant SCN: 000015 was also issued on Dec.14, 2016.

The petitioner alleged that the two CCB acknowledgment slips were issued to Justice Onnoghen when he had been sworn-in as the CJN.

"The affidavit for SCN: 000014 was sworn to on 14th December 2016; 2 of 6 b. The affidavit for SCN: 000015 was sworn to on 14th December 2016.

"Both forms were received on 14th December 2016 by one Awwal Usman Yakasai.

"The discrepancy between Justice Walter Onnoghen's two CCB forms that were filed on the same day is significant.

In filling the section on Details of Assets, particularly cash in Nigerian Banks, His Lordship as Declarant SCN: 000014 mentioned only two bank accounts,'' the petitioner alleged.

According to the petitioner, the CJN runs Union Bank account number 0021464934 in Abuja, with balance of N9, 536,407 on Nov. 14, 2014.

The body alleged that the second account the CJN said he runs is Union Bank number 0012783291 in Calabar, with balance of N11, 456,311 as at Nov. 14, 2014.

The petitioner said the sources of the funds in the accounts were stated as salaries, estacodes and allowances.

The petitioner, however, alleged that Justice Onnoghen as Declarant SCN: 000015, had listed seven bank accounts that were in use.

The group said the CJN was linked to Standard Chartered account 00001062667, with balance of N3, 221,807.05 as at Nov. 14, 2016.

Another account they alleged was operated by the CJN included Standard Chartered account 00001062650, with balance of $164,804.82, as at Nov.14 2016.

The other account linked to him is Standard Chartered with account number 5001062686, with balance of 55,154.56 Euros as at Nov. 14, 2016 among others.

Sen. Uba has done well – Group replies critics

The Anambra South People's Forum on Friday, responded to critics of Senator Andy Uba saying that so far, the lawmaker's performance and contribution to his constituency were commendable.


The group in a statement issued on Friday, signed by the coordinator, Dr James Okeke and 40 other members, faulted those who criticised the senator, describing them as street demagogues.

The statement said that his critics had neither experience nor the grit to legislate for the betterment of the people.

The coordinator in the statement pointed out that the unfounded criticisms will not cause well-meaning members of the constituency from voting for their Choice, Sen. Andy Uba.
"We the members of the Anambra South People's Forum have in recent times become mortified at the penchant of some persons masquerading as candidates and contenders for the Anambra South Senatorial District to pursue a campaign of calumny against the aspiration of Senator Uba.

"Some of these candidates who have no structure nor base required to win elections comfortably, prefer to throw mud undeservedly at the most popular candidate, with the intention of getting a non privileged response from such a candidate.

"Thankfully, the person of Senator Uba, is much focused on telling the people what he has so far achieved and why he needs another term.

"However as stakeholders in this senatorial district, we would be failing in our duties if we fail to respond to these candidates.

The group pointed out that the senator had sponsored several bills at the National Assembly that will benefit the people, with the most recent being the bill to establish e Federal University in Uga, the hometown of the lawmaker.

"Senator Uba in the 8th Assembly has sponsored more bills on the floor of the Senate than any other senator.

"In terms of constituency projects, Sen. Uba has facilitated the construction of 35 classroom blocks and the renovation of 25, the provision of 40 boreholes and overhead tanks in the seven local government areas that make up the zone for the provision of potable water to communities lacking them.

President Muhammadu Buhari has made a shocking disclosure that millions of dollars have been traced to the accounts of the suspended Chief Justice of Nigeria, Justice Walter Onnoghen.
In a speech at the swearing in of the acting CJN, Tanko Mohammed, Buhari dwelt extensively on the corruption case against Onnoghen and how lawyers and some judges have made a mockery of a matter that was so straightforward: whether Onnoghen declared his assets as prescribed by the law.

"Although the allegations in the petition are grievous enough in themselves, the security agencies have since then traced other suspicious transactions running into millions of dollars to the CJN's personal accounts, all undeclared or improperly declared as required by law", Buhari said.

A short while ago, I was served with an Order of the Code of Conduct Tribunal issued on Wednesday 23rd January 2019, directing the suspension of the Chief Justice of Nigeria, Honourable Justice Walter Nkanu Samuel Onnoghen from office pending final determination of the cases against him at the Code of Conduct Tribunal and several other fora relating to his alleged breach of the Code of Conduct for Public Officers.

The nation has been gripped by the tragic realities of no less a personality than the Chief Justice of Nigeria himself becoming the accused person in a corruption trial since details of the petition against him by a Civil Society Organization first became public about a fortnight ago.

Although the allegations in the petition are grievous enough in themselves, the security agencies have since then traced other suspicious transactions running into millions of dollars to the CJN's personal accounts, all undeclared or improperly declared as required by law.

Perhaps more worrisome is the Chief Justice of Nigeria's own written admission to the charges that he indeed failed to follow the spirit and letter of the law in declaring his assets, citing ''mistake'' and ''forgetfulness'' which are totally unknown to our laws as defences in the circumstances of his case.

One expected that with his moral authority so wounded, by these serious charges of corruption, more so by his own written admission, Mr. Justice Walter Onnoghen would have acted swiftly to spare our Judicial Arm further disrepute by removing himself from superintending over it while his trial lasted.

Unfortunately, he has not done so. Instead, the nation has been treated to the sordid spectacle of a judicial game of wits in which the Chief Justice of Nigeria and his legal team have made nonsense of the efforts of the Code of Conduct Tribunal to hear the allegation on merit and conclude the trial as quickly as possible considering the nature of the times in which we live.

Whether deliberately or inadvertently, we have all seen the full weight of the Chief Justice of Nigeria descend on the tender head of one of the organs of justice under his control. There is simply no way the officers of that court, from the Chairman to the bailiffs, can pretend to be unaffected by the influence of the leader of the Judiciary.

Not only the trial court, but others have been put on the spot. Practically every other day since his trial commenced, the nation has witnessed various courts granting orders and counter-orders in favour of the Chief Justice of Nigeria, all of them characterised by an unholy alacrity between the time of filing, hearing and delivery of judgment in same.

The real effect has been a stalling of the trial of Justice Onnoghen, helped along by lawyers who insist that these orders, whether right or wrong are technically valid, and must be obeyed till an appellate Court says otherwise. No doubt, that it is the proper interpretation, but is it the right disposition for our nation?

Nigeria is a constitutional democracy and no one must be, or be seen to be, above the law. Unfortunately, the drama around the trial of the Chief Justice of Nigeria has challenged that pillar of justice in the perception of the ordinary man on the street. For it is certain that no ordinary Nigerian can get the swift and special treatment Justice Onnoghen has enjoyed from his subordinates and privies in our Judicature.   

In the midst of all these distracting events, the essential question of whether the accused CJN actually has a case to answer has been lost in the squabble over the form and nature of his trial. This should not be so.

If Justice cannot be done and clearly seen to be done, society itself is at risk of the most unimaginable chaos. As a Government, we cannot stand by wailing and wringing our hands helplessly but give our full backing and support to those brave elements within the Judiciary who act forthrightly, irrespective of who is involved.

As you are all aware, the fight against corruption is one of the tripod of policies promised to Nigerians by this administration.  Needless to say that it is an existential Policy which must be given adequate attention and commitment by all the three arms of government. The efforts of the Executive will amount to nothing without the cooperation of the Legislature and especially the Judiciary.< It is no secret that this government is dissatisfied with the alarming rate in which the Supreme Court of Nigeria under the oversight of Justice Walter Onnoghen has serially set free, persons accused of the most dire acts of corruption, often on mere technicalities, and after quite a number of them have been convicted by the trial and appellate courts. Since there is nothing the Executive Arm can do after the apex court of the land has spoken on any matter, several of these individuals walk free among us today, enjoying what are clearly the proceeds of the corruption which for so long has defeated the efforts of this nation to develop and prosper. It is against this background that I have received the Order of the Code of Conduct Tribunal directing me to suspend the Chief Justice pending final determination of the cases against him. It also explains why I am not only complying immediately but with some degree of relief for the battered sensibilities of ordinary Nigerians whose patience must have become severely over-taxed by these anomalies. In line with this administration's avowed respect for the Rule of Law, I have wholeheartedly obeyed the Order of the Code of Conduct Tribunal dated 23rd January 2019.

Accordingly, I hereby suspend the Honourable Mr Justice Walter Nkanu Samuel Onnoghen, GCON as the Chief Justice of Nigeria pending final determination of the case against him at the Code of Conduct Tribunal.

In further compliance with the same Order of the Code of Conduct Tribunal, I hereby invite Honourable Justice Ibrahim Tanko Mohammed JSC, being the next most Senior Justice in the Supreme Court, to come forward to take the Judicial Oath as Chief Justice of Nigeria in an Acting Capacity.

Fellow Nigerians, we can only stand a chance to win the fight against Corruption and position our dear nation for accelerated development when we stand together to contend against it.

The Prof. Jerry Gana Presidential Campaign Team says its candidate will appeal the court judgment that recognised former Governor of Cross River, Mr Donald Duke, as the Social Democratic Party (SDP) presidential candidate.

The Director-General of the campaign Team, Mr Ike Neliaku, at a press conference on Friday in Abuja described the judgment as unacceptable and a miscarriage of justice.

The Court of Appeal, Abuja division, in a unanimous decision of the panel, on Thursday recognised Duke at the party's presidential candidate.

The three-man panel of the appellate court in a judgment delivered by Justice Abdul Aboki on the appeal filed by Duke reversed the earlier judgment of an Abuja High Court which upheld Gana as the party's candidate.

Neliaku, who said that the team's confidence in God and the avowed integrity of the judiciary remained intact, however, raised some concerns about the judgment.

The concern according to him include the role played by the party's National  Chairman, Chief Olu Falae,  and what he termed as "obviously unfair and skewed composition of the Appeal Court panel.''

He said that while the chairman had earlier expressed optimism that the judgment was going to be in favour of Duke, he also alleged that two of the panel Justices  came from "the home states of either Duke or his running mate.''

"We were utterly shocked, dumbfounded and dismayed when the appellant lead Counsel thanked the Justices for their adventure into other matters not canvassed by the parties in the Appeal. This absurdity is one of its kind! '

"Arising from the above and many other lacunas and contradictions in the judgment, we have carefully weighed the views and options presented by our stakeholders and supporters across the world, and resolved to accede to what is in the long term interest of our democracy.

"It is therefore our considered opinion that the judgment of the Court of Appeal is erroneous, contradictory and a miscarriage of justice. The decision is therefore not acceptable to us.

"Accordingly, our candidate, Gana, has resolved to appeal the judgment at the Supreme Court.

"We believe that, apart from setting the records straight and clarifying matters of Constitutional Order, this will strengthen our electoral law, enrich our jurisprudence, as well as deepen and widening our democracy.''

Neliaku, however, congratulated Duke for his victory at the appeal Court and also advised him to commence his campaign.

"While the Court process is ongoing, we expect Duke to urgently launch out and commence his presidential campaign activities nationwide, with the objective of winning the 2019 presidential election for the SDP.

"We came into the race with strong determination, conviction, commitment, strength of character and clearer roadmap to winning the 2019 presidential election, and not to settle for lesser objectives.

"Meanwhile, we will continue to join forces with credible candidates of our Party across the country, to campaign and help them with the requisite mobilisation and support to win their respective elections.

Neliaku appealed to all SDP compatriots across Nigeria and in the Diaspora to remain calm, saying, " we must keep hope alive, being confident that we remain very much in the race for the 2019 presidential election.

"We shall continue with the battle and the struggle to save the soul of Nigeria. We Shall overcome and bounce back soon.''

He, however, expressed the belief that the SDP structure as presently constituted was in a position to win the presidential election if properly harnessed and mobilised.

NAN reports that Duke had emerged SDP candidate at the presidential primaries held on Oct. 7, 2018 but Gana,who contested the ticket with Duke, instituted a case against the result at the Federal High Court, Abuja.

On Dec. 14, 2018 the court presided over by Justice Hussein Baba-Yusuf delivered judgment in favour of Gana, declaring him as the right SDP candidate and directed the party to forward his name to INEC.

However, when the commission published the full list of cleared presidential and vice presidential candidates of parties on Jan. 17,  the SDP column carried some remarks: "court order'' and "party yet to submit name of candidate".

Justice Onnoghen’s Suspension: Buhari’s Action Amounts To Coup – Saraki

Dr. Abubakar Bukola Saraki, Nigeria's President of the Senate,  has described the suspension of the Chief Justice of Nigeria, Hon. Justice Walter Onoghen by President Muhammadu Buhari as a coup against democracy and a deliberate attempt to endanger our hard-won democracy.

Saraki, in a statement personally signed by him, stated that the suspension was another act of desperation by President Buhari.

He noted that by the suspension of the CJN, Buhari had acted outside the provision of the constitution, exercised the powers which he does not have and that this action amounted to gross misconduct, Daily Post reports.

"This action is capable of undermining the nation's judiciary, subverting the constitution, intimidating judges of all the courts of record, and creating uncertainty in the electoral process.

"By unilaterally suspending the CJN without following the provision of the constitution, President Buhari has sent a dangerous signal to the entire world that Nigeria is no longer a democratic nation and that we have returned to the old, jaded era of military dictatorship .

"Our constitution makes no provision for suspension of the nation's highest judicial officer. The constitution provides a clear process for removal of the CJN and specify the roles of the three arms of government, beginning from the National Judicial Council (NJC), the National Assembly and lastly, the Presidency, have different roles to play in that process.

"There is no condition under which the President can usurp the powers of other arms of government. I do not know where the President and his advisers got this idea of suspending the CJN on the so-called order of the Code of Conduct Tribunal but this is novel, disingenuous and alien to our laws. It is strange that President Buhari is claiming to be taking orders from a Tribunal which has been ordered by a superior court to halt all actions on the trial.

"With this action, President Buhari has initiated a process the consequence of which nobody can predict. They have precipitated a constitutional crisis.

"At this point, all democratic institutions in the country, the international community and democrats across the world should rise against this blatant act of impunity. We should jointly condemn this retrogressive, uncivilized and despotic measure", Saraki stated.

He, however, call on President Buhari to immediately reverse this decision and allow the due process of law to take its natural course in determining the guilt or otherwise as well as the suitability of Hon. Justice Onnoghen to continue as the head of the nation's judiciary.

Justice Onnoghen: Buhari Has Finally Insulted The Constitution – Agbakoba Speaks On CJN’s Suspension

Chief Olisa Agbakoba (SAN), former President of Nigerian Bar Association (NBA),  has blasted the decision of President Muhammadu Buhari to suspend Justice Walter Onnoghen, as the Chief Justice of Nigeria.

Buhari had on Friday suspended Justice Onnoghen and immediately appointed Tanko Mohammed as acting CJN.

Explaining his reason, the President said he suspended Onnoghen, following an order from the Code of Conduct Tribunal, CCT, asking him to wield the big stick.

In a statement forwarded to DAILY POST, Agbakoba made it clear that Buhari's action "is the most brazen assault on Nigeria's constitutional history" and criticized Mohammed for accepting to be sworn in.

"President Muhammadu Buhari's suspension of the Chief Justice of Nigeria, Justice Walter Onnoghen, is the most brazen assault on Nigeria`s constitutional history.

"The President has obviously not listened to the advice of the Hon. Attorney General of the Federation or the Attorney General of the Federation has misadvised him or both.

"President Buhari claims that the suspension of the Chief Justice Onnoghen is pending the determination of the Code of Conduct Tribunal, CCT. This is simply not true. The CCT itself adjourned proceedings in respect of Justice Onnoghen`s matter in order to determine if it had jurisdiction to try Justice Onnoghen. The President`s decision contravenes the Ruling of the CCT.

"There are at least six (6) pending cases in superior courts of Nigeria and one in the Court of Appeal. All these cases ruled that Justice Onnoghen should remain in office pending when all cases against him are resolved. These Rulings bind the President of Nigeria. In any case Section 292 of the 1999 Constitution of Nigeria sets out the procedure for removing or suspending the Chief Justice of Nigeria. The power to suspend or remove the Chief Justice of Nigeria vests in the Senate side of the National Assembly.

"For all these reasons the purported suspension of Chief Justice Onnoghen is the gravest insult to Nigerian constitution in history. It is difficult to understand how President Buhari will expect my vote of confidence in the February polls if he wantonly denigrates and desecrates our Constitution.

"I call on all Nigerians to take the strongest possible view of the President`s conduct. I am shocked that Mr. Justice Mohammed Tanko would have offered himself to be sworn in as the Acting Chief Justice of Nigeria.

"I call on the Chief Justice of Nigeria to refuse to be pushed out of office. The NBA must rise to resist this assault to our constitution.
Our judges must rise; Civil Society Organizations must rise. This is potentially the beginning of our descent into constitutional anarchy."

INEC Backs Out From Defending Oyetola's Declaration As Osun Governor (Full Details)

It was a political earthquake today in Abuja as the Independent National Electoral Commission closed its submission before the Osun Election Petition Tribunal without calling a single witness and with a clearly disturbed countenance.

At the resumed hearing today in Abuja, the commission through its counsel Adesina Agbede rose in disquiet to apply to close his case to the other consternation of even APC and Gboyega Oyetola's legal team.

The counsel had staked his reputation yesterday when he promised the tribunal that the witnesses would testify at today's proceedings. The Tribunal Chairman quickly come to the aid of the disturbed counsel by ruling that he needs not apply to close INEC defence ,urging him to proceed to close his case.

The INEC counsel eventually closed the case without canvassing any arguments against the presentations, submissions and prayers of the petitioner that Ademola Adeleke be declared the rightful winner of the election based on the results of September 22nd.

The Real Details...

Checks however showed that INEC stopped further presentations due to inability to assemble the right witnesses. It was learnt that very few were ready to come and testify in defence of the violently manipulated rerun on the basis of which Oyetola was declared winner.

Two, the few who were ready could not be tutored to say white is black especially with respect to the alteration of results sheets.

Three, INEC discovered that PDP cross-examination will only strengthen petitioner's case that the rerun was a sham and that cancellation of some polling units in September 22 was an exercise outside and against the spirit of the law.

"Most witnesses they would have called will eventually be confirming the disparity between the so called certified true copies of the results and the pink copies with PDP agents. INEC witnesses would have ended up as petitioners' supporters ", a public interest lawyer who was in court said.

Eventually the few witnesses who were mobilised for INEC were not utilised as the counsel felt that they would further weaken the case of the defendants and strengthen the petitioner's position that INEC exercised powers it does not have by cancelling the seven polling units and by declaring the election inconclusive.

INEC has conceded to our Petition-PDP Lawyer

Speaking on the implication of INEC decision lead counsel for the petitioner, Dr. Paul Ananaba SAN said INEC has literally endorsed and conceded to the PDP petition seeking declaration of Senator Adeleke as the winner of the election.

According to the legal luminary, our case is primarily against the actions and decisions of INEC and if they cannot challenge our Petition, and if they can not provide any defence for their actions that declared  Oyetola as winner, then the  commission has literally admitted that our petition is right and correct before the law and God.

"A key pillar of our case is that the returning officer without legal powers cancelled results of seven polling units  and proceeded to declare the election  inconclusive. INEC failed to declare PDP and her candidate winner even after fulfilling all constitutional stipulations. We also complained that INEC altered result sheets and that the commission published results where there was no accreditation and ballot accounting.

"We called 80 witnesses to authenticate our pleadings and prayers and also tendered over 500 pieces of evidence. By closing its case without any defence, INEC is saying we cannot challenge petitioner's case. INEC has accepted that we are right in our prayers that the rightful winner of the election is PDP'S Ademola Adeleke.

"INEC is the one that committed the infractions and it has literally accepted our pleadings and prayers .We will be surprised if APC and her candidate will challenge our petition in the light of INEC's action today. The honourable thing for APC to do is to throw in the towel and avoid wasting the time of the court", the senior lawyer said.

The tribunal adjourned further sitting till Wednesday, January 30.

The ruling All Progressives Congress (APC) on Friday reacted to the endorsement of presidential candidate of the main opposition party, Peoples Democratic Party (PDP), Atiku Abubakar.

APC National Publicity Secretary, Mallam Lanre Issa-Onilu, said this came after Atiku has tactically avoided speaking on his restructuring plans during his campaigns.

He noted that with a few members of Ohaneze falling for Atiku's antics, it has now become clear that the purported endorsement of Atiku's presidential ambition does not enjoy the support of most of the Igbos.

The spokesman in a statement made available to DAILY POST said: "One such proofs is the statement by the Anambra State Government's dissociating the state from the dubious endorsement of Atiku contained in the equally disputed communique.

"It would now seem that few people in Ohaneze are trying to misrepresent the interest of the Ndigbo and we wonder whether these people are part of Atiku's friends that he has promised to make rich as a cardinal policy of his government?

"Many questions beg for answers. Besides the deceitful restructuring promise, what else do the Igbo stand to gain from an Atiku presidency? Nothing!

"Could it be that Atiku and the PDP's restructuring rhetoric is selective and bespoke for specific audiences? The answer is yes! Atiku's restructuring rhetoric is simply a convenient, simplistic and populist gimmick aimed at whipping up and exploiting perceived sentiments ahead of the 2019 elections.

"Ndigbo and indeed all Nigerians must be wary of Atiku and his PDP ilk who in their desperate quest for power are ever ready to play fraudulent political games and parade themselves as ethnic champions to the gullible. We must protect the sanctity of our nationhood.

"Atiku has refused to speak on the nature of the restructuring that he is cashing in on. But little wonder because he is transactional in nature. Atiku has no plan for this country and he is not pretending about it. He has said it clearly and on many occasions that he is seeking power to be able to sell off national assets to make his friends and himself rich. There is no doubt that Atiku only intends to use and dump the Igbo people.

"Ndigbo should not forget that it was during the administration of former President Olusegun Obasanjo and Atiku as vice that Nigeria's political history witnessed the frequent manipulated changes to the Senate Presidency and setting of Igbo brothers against one another for political gains.

"Without playing to the gallery, the President Muhammadu Buhari-led APC administration has pursued a deliberate policy of probity, inclusive governance and national spread in the allocation of our national resources and developmental projects across the country.

"In particular, about 69 verifiable road and bridge projects are ongoing in the southeast. This is unprecedented in the history of our nation. Although the contracts for many of the roads were awarded by past PDP administrations, they were either poorly funded or not funded at all, hence work on the road and bridge projects were previously stalled.

"Currently, the roads and bridges, which are spread across the five states in the South-east, are in different stages of completion, thanks to the funding sourced by the president Buhari-led APC administration from budgetary allocations, the Sukuk Bond and the Presidential Infrastructure Development Fund.

"The APC remains the most sincere political platform working to ensure better inclusion and mainstreaming of all geo-political zones in the governance of the country. We have held constructive, purposeful, country-wide and multi-sectoral conversation on core issues of true federalism and devolution of powers in line with the Party's Change Agenda.

"Ndigbo and indeed all Nigerians must be wary of the machinations of conmen who now masquerade as 'messiahs' in the garb of politicians. Their antecedents does not synchronise with the image they now purport which is dangerous. They are latter-day converts on the issue of restructuring who hitherto occupied public offices and did nothing on the issues of restructuring.

"They have now regrouped to exploit the issue of restructuring in furtherance of their selfish political interests. Their sudden silence on the issue of restructuring is certainly ominous. The Ndigbo should not fall for this fraud."

JUST IN: Buhari Suspends Justice Onnoghen, Appoints New CJN

The Chief Justice of Nigeria (CJN), Justice Walter Samuel Nkanu Onnoghen, has been suspended by President Muhammadu Buhari.

This was disclosed by the President's media aide, Bashir Ahmad on his official Twitter handle.

President Buhari has immediately appointed Mr. Ibrahim Tanko Muhammed as acting CJN.

Bashir Ahmad wrote: "President Buhari suspends the Chief Justice of Nigeria (CJN) Walter Samuel Nkanu Onnoghen and appoints Mr. Ibrahim Tanko Muhammed as acting CJN."

Justice Onnoghen: I Haven’t Resigned; To Inaugurate Election Tribunal Members - CJN Onnoghen Says

The Chief Justice of Nigeria, Justice Walter Onnoghen, will be swearing in the members of the various 2019 election petition tribunals on Saturday, January 26.

The CJN said this through his media assistant, Awassam Bassey, on Friday.

Mr Onnoghen also described as absolute falsehood, the media reports that he resigned his office, following current allegations against him.

In a statement sent to PREMIUM TIMES by Mr Bassey on Friday, the CJN urged Nigerians to disregard the rumour and added that he is still performing his role as CJN.

"There's absolutely no truth in the rumours making the round that the Hon. Chief Justice of Nigeria, His Lordship Hon. Mr. Justice Walter Samuel Nkanu Onnoghen, GCON, has resigned his office. It is fake news!

"The Hon CJN was in the office all through yesterday (Thursday) and sat in court. As part of his duties, the Hon CJN will be swearing in members of the 2019 National Assembly, Governorship & State Assembly Election Petition Tribunals tomorrow (Saturday 26th January 2019)," the statement said.

Mr Onnoghen is facing trial over alleged false asset declaration brought against him by the Code of Conduct Bureau.

The Attorney General, Abubakar Malami has also requested that Mr Onnoghen resigns from office, following the various allegations.

The case, currently ongoing at the CCT was adjourned till January 28.

But the Court of Appeal on Thursday ordered the tribunal to suspend sitting, pending the discharge of current applications before it.

The Court of Appeal will give its verdict on the matter on January 30.

The appeals were brought by Mr Onnoghen who wants his trial halted, citing lack of merit.

Five arrested in Italy for forced prostitution of Nigerian women

Five people have been arrested in Italy for smuggling Nigerian women into Europe and forcing them into prostitution, according to Italian Carabinieri Police.

The suspects, apprehended in the Sicilian town of Messina, were part of an organised crime racket that smuggled "at least 15'' unaccompanied minors into "several European Union countries'' via Libya and Sicily, the police said in a statement yesterday.

The syndicate relied on an Italian accomplice who worked in a migrant charity.

According to Police, he would help the criminals trace the women after their arrival in Sicily and contribute to forcing them into prostitution.

The Carabinieri said they documented criminal activity during the 2015 to 2017 period.

They said "black magic'' rituals would be performed on the young women before they left Nigeria, to force them into submission.
Some of the arrested also dabbled in heroin trafficking, police said.

In 2017, a report by the International Organisation for Migration said three-quarters of the roughly 11,000 Nigerian women who landed in Italy in 2018 may have been taken there by sex traffickers.

The IOM, a UN agency, said it was difficult to make precise estimates because most victims of the sex trade are afraid to speak up.

They are also afraid to seek assistance because they are: ashamed; submissive to traffickers accompanying them on migrant boats; or fear retaliation against their relatives
