Court Strikes Out Busola Dakolo’s Rape Suit Against Fatoyinbo, Fines Her N1M

Posted: 15 Nov 2019 10:30 PM PST

A Federal Capital Territory High Court sitting in Bwari has dismissed a suit filed by photographer, Busola Dakolo, against the Senior Pastor of the Commonwealth of Zion Assembly, Pastor Biodun Fatoyinbo.

The court also ordered Busola to pay N1m for wasting the court's time.

In a suit, filed by Busola, wife of Musician, Timi Dakolo, in September, she had accused Fatoyinbo of rape, adding that the alleged action of the pastor, as well as his denial in a statement adversely, affected her marital sex life.

She, therefore, demanded "a personal letter of apology" from the cleric to show honest remorse for his misdeeds.

Fatoyinbo's lawyer, Alex Iziyon (SAN), however, argued that the prayer could not be granted, describing it as a frivolous suit.

In his ruling, Justice Oathman Musa held that the matter amounts to injustice and an abuse of judicial process adding that the case is empty and purely sentimental. Justice Musa said that the case was aimed more at cruelty than obtaining justice.

The court also awarded costs of N1m against Busola Dakolo and held that the fine should have been 10 times more because the court's time was wasted.

In her suit, which was filed on her behalf by her lawyer, Pelumi Olajengbesi and Co of Law corridor, Mrs Dakolo asked the court to declare that Fatoyinbo's denial of his alleged acts contained jointly and/or severally through a press statement he released on June 28, 2019, had caused her continuous emotional distress and amounted to intentional infliction of emotional distress on her.

Olajengbesi said, "The claimant avers that she was immediately terrified and in shock while the defendant pinned her down on the couch following which he caressed her body, fondled her breasts, pulled her pants, quickly half-pulled his trousers and ordered her to allow him to have his way with her.

"The claimant avers that the defendant in the process used his hand to cover her mouth, thereby muffling her screams. The claimant avers that the defendant made efforts to penetrate her vagina, whilst she struggled to fight him off; however, the defendant overpowered her and penetrated her vagina and had sexual intercourse with her.

"The claimant avers that while she was in shock of the incident which had rendered her befuddled and mortified, the defendant rushed out of the living room area of her family home and briefly returned with a bottle of soda (Krest) which he forced down her throat thereby making her breathing difficult."

Meanwhile, the Nigeria Police Force says the probe into the allegation of rape against Fatoyinbo is slow because the alleged crime took place 20 years ago.

Busola Dakolo speaks after court ruled out her rape case says "She’ll appeal court judgement"

Posted: 15 Nov 2019 09:30 PM PST

Celebrity photographer, Busola Dakolo, on Thursday said she would appeal the ruling of Justice O. A. Musa of the Federal Capital Territory High Court in Abuja against Pastor Biodun Fatoyinbo of Commonwealth of Zion Assembly over alleged rape.

Her lawyer, Pelumi Olajengbesi, said this in a statement sent to The PUNCH in Abuja in reaction to the court verdict.

He said, "We have received several calls after the ruling of the high court of the Federal Capital Territory sitting at Bwari this morning seeking our view on the decision of the court, hence, this statement.

"The court ruled that the matter is statute-barred because the events that crystallised to the cause of action took place 16 years ago and that the claimant Mrs. Busola Dakolo has only six years within which to seek redress in court in line with the statute of limitation.

"We are mindful of the decision as delivered by the court, presided over by the Hon. Justice A.O Musa. We are equally observant of the fact that the Court omitted to address the cause of action, the subject matter of the suit in determining whether it has jurisdiction to entertain the said matter.

"While we acknowledge the time of the court, we know in accordance with the Nigerian judicial system that the Court's decision is not final as it is glaringly contestable.

"For all intent and purposes, having seen several sponsored misleading news reports in the media, we are duty-bound to state that the court has not and did not exonerate Biodun Fatoyinbo. As it stands, the substance of the matter has not received any judicial attention.

"Biodun Fatoyinbo through his lawyers have only argued that the court should not allow the matter to proceed to trial because it is an event that occurred long ago and hence out of time.

"We shall therefore in this circumstance approach a superior court to intervene for a better appreciation, and take a more expansive view of the suit considering that the subject matter is one that is novel in our clime."

Yahaya Bello's re-election appeal by El-Rufai, attract massive reactions from Nigerians
Governor Yahaya Bello

Governor Nasir El-Rufai's begging of voters in Kogi State to support and vote Governor Yahaya Bello in next Saturday's governorship elections, have attracted various social media reactions from Nigerians.

Mallam El-Rufai, who heads APC campaign council for Kogi, went down on his knees before the electorate asking them to forgive Governor Bello "for all the wrongs he might have done to them during his first tenure and ensure his re-election," Premium Times reports.

According to a video shared by Channels TV, Gov. Yahaya Bello was shown clapping in the background, while El-Rufai was begging the electorates.

See reactions from Nigerians below as compiled by Premium Times:

"Many people say that Yahaya Bello is young and that he has offended many people. Anybody that Yahaya Bello has offended, I am asking all of you to forgive him. He is young and bound to make mistakes and learn from them.

"On his behalf, I'm appealing and kneeling down to forgive Yahaya Bello if he has offended you. He means well for Kogi State. He has brought young people into government. He has brought women into government. He has cleared salary arrears owed by past governments. You must all come out and support him. I beg you all," Mr El-Rufai pleaded.

Since then, Nigerians have been airing their views, mostly on Twitter.

Some of the commentators expressed their discontentment at the APC candidate's style of governance in the state.

Some of the comments are listed below:

"Finally, APC agrees that Yahaya Bello failed woefully.

Thank you Elrufai, but next time, make sure you're kneeling down to beg him to pay salaries and not for the suffering people of the state to reinforce nonsense.

Thank you." – Henry Shield (@henryshield), wrote on his wall.

Another twitter user, Boda Joe, compared the four years rule of Mr Bello to "100 days in office of a PDP governor in Oyo State".

"There's a saying that *a fool @ 40 is a fool forever* Yahaya Bello is 44 and they are begging for his forgiveness for not paying over 30mnts salary nor a single project cos he's young and can make mistakes.

"Even Seyi Makinde in 100days has done more than Yahaya Bello in 4yrs." – @_mrjoe commented.

"Dear Kogi people. Don't miss the only chance you have to get your salaries paid. Aisha Buhari does not cook soup in her house with promises. Send a message to Yahaya Bello. Tell him unless all your arrears are in your account before voting commences, you are voting PDP," he said.

Also commenting, the main opposition party, PDP, via its verified Twitter handle wrote:

"The@OfficialPDPNig says the public apology and kneeling by the Chairman of the @OfficialAPCNg Kogi state campaign council, Kaduna state Governor @elrufai, confirms that even the APC agrees that Governor Yahaya Bello does not merit a second term."

Present at the occasion were the First Lady, Hajiya Aisha Buhari, Wife of the Vice President, Mrs Dolapo Osinbajo, the APC National Chairman, Adams Oshiomhole and seven other state APC governors or representatives.

Fibre broadband may become obsolete by 2030 - and what about 5G technology?

Fiber cables.        credit: GETTY IMAGES

The UK Labour Party has promised to give every home and business in the UK free full-fibre broadband by 2030 if it wins the general election.

The plan would see millions more properties given access to a full-fibre connection, though Prime Minister Boris Johnson said it was "a crackpot scheme".

If the plan went ahead and was completed on time, would it still be useful in 2030?

What is full-fibre broadband?

There are three main types of broadband connection that link the local telephone exchange to your home or office:

-ADSL (asymmetric digital subscriber line) uses copper cables to a street-level cabinet or junction box and on to the house

-FTTC (fibre to the cabinet) uses a faster fibre optic cable to the cabinet, but then copper cable from there to the house

-FTTP (fibre to the premises) uses a fibre optic cable to connect to households without using any copper cable.......READ MORE>>>

Rape victim

A policewoman (name withheld), who is 45 years of age, on Thursday narrated to an Ikeja Sexual Offences and Domestic Violence Court how a fellow police personnel, Mohammed Alidu, allegedly defiled her nine-year-old daughter in a police barracks.

The News Agency of Nigeria (NAN) reports that the policewoman was the second Prosecution Witness (PW2) in the of trial of Alidu, a police sergeant, for defilement.

The PW2 was led in evidence by Mr Akin George, Deputy-Director, Lagos State Directorate of Public Prosecutions.

She said that the defendant accosted her daughter (name withheld) on her way home from school, dragged her into his house and defiled her.

"We live at Makinde Barracks, Mafoluku, Oshodi, Lagos.

"On June 29, 2018, I was at work when my husband, who was out of Lagos, called me to inform me that Sgt. Mohammed defiled our daughter.

"I went to the police station which is within the same compound of the barracks, and my daughter was in the police station.

"My daughter told me that when she was coming back from school, Mohammed called her but she did not respond.

"She said he forcefully took her to his apartment, put her on a bed, tore her underwear and defiled her," she said.

According to her, Mohammed was also at the police station, begging and telling the divisional police officer that it was the work of the devil.

The policewoman said that her daughter was taken to the Mirabel Center (a sexual assault referral centre) for medical examination, and doctors confirmed that she was defiled.

During cross-examination by defence counsel, Mr Sunday Odise, the policewoman told the court that the defendant lived near her residence.

"He did not have a house within the barracks. He was sleeping in a shop opposite our home," she said.

Earlier, the PW1 and the investigative police officer of the case, Sgt. Juweratu Ashiru, told the court that shortly the alleged defilement, the victim reported the incident at the police station.

"She told me that when Mohammed dragged her into the wooden house he lived, to defile her, she screamed during her ordeal and that no one rescued her.

"Mohammed was arrested at the wooden house where the crime occurred, and when we took his confessional statement, he said that it was the devil's work.

"He said we should forgive him and drop the case, but we refused and said that he must face the full wrath of the law.

"The victim's underwear was torn. I recovered the underwear and it was kept as an exhibit in the Gender Unit of the Police Force," Ashiru said.

NAN reports that Justice Abiola Soladoye ordered members of the public to leave the courtroom when the alleged victim, now 10-year-old, was to give evidence.

After she testified, the judge adjourned the case until Jan. 15, 2020, for continuation of of trial.

Nollywood Actress Padita Agu opens up about her 3-year-old failed marriage

Posted: 15 Nov 2019 06:00 AM PST

Actress Padita Agu has shared the sad story of how her three-year old marriage packed up.

In a video she shared on her Youtube page, Padita narrated how she got married to her ex-husband the very first day they met after maintaining a long distance relationship over the phone.

According to her, she met her ex-husband at a friend's house. She had gone to the friend's house to console her and this friend later called to tell her that the man who was in her house when she came visiting, was interested in her and wanted her number.

Padita who was in a relationship at the time, said she turned down her friend's request to speak with the man. Her friend pressured her so much and she gave into her friend's request and decided to speak with the man. At the time they spoke, the man was living outside the country. After much communication via phone, they started to talk about marriage. It was in one of their many conversations that he sold her an idea that she says she regrets till date.

"This guy and I have been talking over the phone and we got to the point of agreeing to be married. So he decided to sell me this wonderful idea, that how about we go on some adventure, lets get married the very first day we get to see because all this while we have been taling, I don't remember his face. I haven't seen him. He just saw me once when I came to my friend's place to consolde her. He might I seen me in my movies, I don't know. All I know is that at this point, we don't really know each other. We haven't seen each other but we have been talking over the phone. I don't remeber his face, I don't remember how he looks but we have been talking so we are so familiar but not just facially.

So he said okay, how about we try some adventure, we arrange a marriage and we just see ourselves right at the registry when we are getting married. I was like wow, that's deep, that is serious. I was like what would my family say? What would I say to them> I was just scared but excited at the same time. So he said for my family, we don't have to tell them about the secret marriage. So once we are done, we would go and meet them as though we were just dating and we tell them we want to get married and we take it from there.

So once we get married, maybe years later, if we had kids and all that, we can now open up to them and say 'oh by the way, we had a secret wedding. At that point, it wouldn't matter because then, we are already married. And as for him and I, once we do it and we meet ourselves and we realise we don't want this anymore, as quietly as we did it, we would just go and undo it.

So I thought to myself, there is no harm in this. If we don't want it again, we dissolve it quietly like he said and my family don't have to know because eventually we would wed properly. So, I thought it was a nice idea.

So, I went to the regustry because he was out of the country at the time. I went to the registry, got us registered. The day came, it was my birthday. He also chose my birthday to make it special. So I felt wow, this is amazing. That day I didn't tell anyone. In between, he told me not to tell anyone. that if I tell people, nobody would encourage it for some negative reason. Some might be jealous.

On the wedding day, I arrived at the registry with a cab. He arrived with a cab. The cabman who brought me signed as my witness while the one who brought him signed as his witness. and we wedded. From their, we went to see my family to tell them we were dating and wanted to get married.

The marriage lasted for three years and that three years is the worst I have ever gone through in my almost four decades of living to the point I attempted suicide. I just wanted to kill myself and end it. There was this thing about actresses not staying in marriage so I just couldn't see myself leaving and so I just wanted to stay there. Since I couldn't leave, I thought I should just end this whole trouble. I know some of you would be like this is why this girl left the industry. Yes, this is why I left the industry. He didn't tell me to leave directly but indirectly, he got me out of the industry, cut me off everyone, everything…my career, my school, my family, friends…ecept friends he was okay with them"

Padita recounted how her ex-husband told her that their marriage was legal and any attempt to annul it, would cause them to incur the wrought of God down to their fourth generation and that she would bear most of the wrought as the wife.

Amongst the lessons Padita says she learnt form the experience is

1. Never give in to pressure be it parental, peer group or societal.

2. Never assume you are familiar with someone you are chatting on talking with on phone or social media. This goes to people in long distant relationships. Never commit deeply until you see that person.

3. Never settle for a spouse you are not compartible with

4. Never leave in Isolation.

Eniola Badmus finally settles beef with Funke Akindele

Posted: 15 Nov 2019 04:00 AM PST

It is a well known fact that the relationship between Nollywood Actresses, Funke Akindele and Eniola Badmus have been rocky and shaky in recent times.

The general belief in town then was that both were no longer on speaking terms and that they had parted ways. What further fuelled the rumor was the absence of Funke at Eniola's grand birthday party.

Well, sharing a photo of Funke Akindele in her Instagram page moments ago, Eniola Badmus wrote "CRUSHING ON YOU SO BAD JUST BECAUSE ITS #WCW @funkejenifaakindele YOU'RE A STRONG AND POWERFUL WOMAN……NA ONLY IF WE COMMOT YOUR WAHALA"

Also in an interview Eniola Badmus had with City people last year, she revealed thus about her relationship with Funke Akindele.

"Funke Akindele and I are still friends. We are sisters. Funke Akindele is one person. I love so dearly with my heart, because of who she is. Also, whether we like it or not, we can't deny the fact that Jennifer blew a lot of us. She gave us that light. It helped a lot of us. We can't forget the fact that it was Funke's film that helped many of us.

At some point in a relationship, there will be ups and down. That is life. We can never have 100% relationship. There are some times you people will have misunderstanding atimes or disagree on some issues. Funke, whether good or bad, I can't fight her. She remains my sister. Funke, whether good or bad, even if she's fighting me, I can't fight her, because I rate her so much. She's up there. She's big. She's been a wonderful person to me.

Whether we like it or not, her brand has actually affected my brand in a good way and I am happy with that fact. If we were fighting, she would not have come for my premiere. Funke Akindele coming for my premiere was like a huge surprise to a lot of people because people were saying a lot then".

In a lengthy Instagram post, Toyin Abraham who reportedly was still married to Adeniyi Johnson when Nkechi Blessing had an affair with him, advised that negative reports should be ignored till they fade away.

Read her full statement below:

"We can't always control the people or circumstances in our lives, but we can always change our reactions towards them. Even at your best, someone will always have something negative to say.
Critics has become absurd just because people now do it for fun. And most of them try to expose what's wrong about you because they can't handle what's right about you. Forgetting everybody is fighting their own unique war. Just focus on who you are and don't entertain any negativity directed at you by others.

People have a right to their opinion and you have a right to ignore it. Accept criticism if you think it's reasonable, as it takes both sun and rain for a flower to grow, however, do not get distracted by the critics of people who doesn't know how to cook but tells you your food needs salt. Refuse to open your mind to other people's trash.

When people throw you stones, it's because you're loaded with fruits. So, throw them your fruits so the seeds of yourself may inspire them to change their ways. The less you respond to negative people, the more peaceful your life will become. IGNORE NEGATIVITIES TILL THEY FADE AWAY!"

Responding, Nkechi Blessing commented on the post with a peace and love sign.
