Court Ruling, Affirming NASS Powers On Election Re-Ordering Laudable - Saraki

The Senate President, Dr. Bukola Saraki, has lauded the judgement of the Court of Appeal which held that NASS has the powers to make laws, including the bill amending election sequence.

The judgement dismissed the earlier verdict of the Federal High Court, which stopped the National Assembly from overriding the assent of the President on the bill.

Daily Post reported that Dr. Saraki in a statement through Mr. Yusuph Olaniyonu, his Special Adviser (Media and Publicity), in Abuja, stated that the judgement had further reinforced the belief of Nigerians that the judiciary remained the hope of the country in strengthening democracy, resolving conflicts between various arms and levels of government as well protecting the rights of individuals.

The Senate President, added that with the judgement, it is now clear that the National Assembly was right when it passed the bill stating the sequence of elections and that the legislature reversed its decision on the issue, after President Muhammadu Buhari refused assent to the bill, in the interest of peace and to forestall any legal obstacle on the way of the 2019 elections.

"I have always believed in the need to test our laws in court by seeking judicial interpretations on contentious issues.

"By doing so, we will be expanding the scope of our laws, sharpening the rough edges of legislation and asserting our faith in the judiciary as a fundamental arbiter", Saraki stated.

President Buhari Receives President Of Gambia, Adama Barrow In Aso Rock

President Muhammadu Buhari played host today to the President of Gambia, Mr. Adama Barrow at the Aso Rock, Abuja, earlier Tuesday.

Mr. Adama Barrow is in Nigeria to thank President Muhammadu Buhari for the role he played in the political transition that ended the twenty-two year-rule of former Gambian leader, Yahya Jammeh.

The Gambian leader expressed his appreciation on Tuesday when he visited President Buhari at the State House in Abuja.

President Barrow who acknowledged the leadership role played by his host in the resolution of the political crisis in Gambia noted that Nigeria has over the years been quite supportive to Gambia particularly in the areas of education, judiciary and technical supports.

He also commended the efforts of regional bodies such as ECOWAS, African Union, AU, and other international agencies that made interventions during the period of political crisis in his country, possible.

President Buhari who hosted the Gambian President alongside his entourage, said Nigeria and Gambia have agreed to draw up a political programme that will be of mutual benefit to both countries.

Adama Barrow won the December 1, 2016 presidential election in Gambia, but faced some political challenges as his Predecessor Yahya Jammeh refused to relinquish power.

The visiting President also congratulated the President Buhari on his election as the new Chairman of ECOWAS, stating that he was the first foreign leader to visit Abuja after the development.

Apple Record Q2 Profits Push Company Near $1 Trillion Mark

Apple CEO Tim Cook: company getting near record one trillion dollar market value

Apple is coasting near the history-making one trillion US Dollar market value after announcing on Tuesday a 30 per cent increase in its profit for the second quarter.

It reported a profit of $11.5 billion, besting market expectations despite selling fewer iPhones than analysts projected.

The news boosted shares in the tech giant in after-hours trading, putting it ever closer to a history-making, trillion-dollar market value, even as China's Huawei knocked Apple off second spot in a tightening global smartphone market.

Apple's revenue in the fiscal third quarter soared 17 percent to $53.3 billion from the same period a year earlier on the back of sales of pricier iPhones, online services and wearable devices.

"We're thrilled to report Apple's best June quarter ever, and our fourth consecutive quarter of double-digit revenue growth," chief executive Tim Cook said in the earnings release.

Apple sold 41.3 million iPhones in the quarter that ended June 30, just shy of the 42 million figure anticipated by analysts.

Shares in the Silicon Valley-based technology titan rose 4.03 percent to $197.95 in after-hours trade that followed release of the earnings figures.

To hit the trillion-dollar market value, Apple shares would have to climb about five percent more.

"Apple gave the Street and tech investors finally some good news" beating earnings forecasts and predicting the current quarter will be strong, GBH insights head of technology research Daniel Ives said in a note to investors.

The company is expected to unveil new iPhone models in the fall, sticking with its practice of releasing upgraded models ahead of the year-end holiday shopping season.

Sales of iPhones in the fiscal third quarter have typically been tame as many fans have historically either bought handsets in prior months or end up waiting for new models in the months to come.

That said, the average selling price of iPhones jumped in the quarter as buyers opted for top-of-the-line X and 8 models, according to Apple.

"If you look at the top of our line together, they are growing very nicely" Cook said.

"IPhone X shows that when you deliver a great innovative product there are enough people out there that would like that and it can be a very good business."

But the good news was slightly tempered after latest figures showed China-based Huawei took the second-place spot from Apple in a tightening global smartphone market during the second quarter of this year.

South Korean consumer electronics titan Samsung remained the top smartphone maker, shipping 71.5 million handsets, but Huawei moved into second position with shipments of 54.2 million, according to IDC Worldwide Quarterly Mobile Phone Tracker.

The 41.3 million iPhones shipped by Apple gave the company 12.1 percent of the global market compared to 20.9 percent for Samsung and 15.8 percent for Huawei.

It was the first time since early 2010 that Apple wasn't in one of the top two spots in the smartphone market, according to IDC

DisCos Declare Losses On N427bn Assets, Five Years After Privatisation, Zero Return On Investment

Electricity Distribution Companies cries out, as almost five years after core investors put $1.2 billion (about N427bn) to acquire 60% stakes in 11 electricity Distribution Companies (DisCos) in 2013, they said they are yet to recover the investments or make profit from the defunct PHCN assets.

The investors disclosed this on Tuesday in Abuja at a joint briefing by the Association of Electricity Distributors Investors and the Association of Nigerian Electricity Distributors (ANED).


The Executive Director, Research and Advocacy at ANED, Chief Sunday Oduntan said, "DisCo investors, who paid $1.4bn (about N427bn) for the distribution assets have not made any return on their investment, a condition which was the basis of the investment after a five-year performance period."


He revealed a N1.3 trillion market shortfall in the DisCos' financial books that hinders their performance on improved metering, customer service and increased customer connections.

23 Lawmakers Of Kwara Assembly Defect To PDP

According to Agency report, twenty-three members of the 24-member Kwara House of Assembly, including all principal officers on Wednesday defected to the Peoples Democratic Party (PDP).

Dr Ali Ahmad, the Speaker of the Assembly, disclosed this during plenary, conveyed in a letter written to the House by the Majority Leader, Mr Hassan Oyeleke, on behalf of concerned members.

All the defected members were in the APC and the only member remaining in the party is Saheed Popoola, representing Ojomu-Balogun Constituency in Offa Local Government Area.

Each of the 23 members, including the speaker, signed the letter of the defection.

According to the News Agency of Nigeria, Ahmad said that the movement to the PDP by the 23 lawmakers became imperative "since the APC has failed to meet the aspirations of Nigerians".

Ahmad alleged that the APC-led Federal Government was harassing and intimidating top government functionaries instead of tackling the problem confronting the nation.

"In 2014, l was terribly sad leaving PDP reluctantly with 36 members of the then House of the Representatives. Today, l am the happiest man leaving APC for good.

"l wish l was never a member of that party,'' the speaker said.

He directed all the defectors to urgently consult the electorate in their various constituencies of the development.

The speaker announced the removal of Popoola, the only APC member in the House as Chairman, House Committee on information, Youth and Sports.

The members replaced Popoola with Abdulrahman Abdulrafiu, representing llorin North West constituency. (NAN)

Governor Aminu Tambuwal, the Governor of Sokoto State,  has triggered serious reactions online after he officially announced his defection from the ruling All Progressives Congress, APC to the Peoples Democratic Party,PDP.

Tambuwal announced his defection on Wednesday while addressing a gathering of politicians and supporters at the Government House in Sokoto.

Oyedepo, Kwara PDP Chairman, And Other Members Defect To The APC

Some members of the Peoples Democratic Party, PDP, in Kwara State, led by Mr. Iyiola Oyedepo, the state chairman, on Wednesday announced their defection to the All Progressives Congress, APC.

A good number of Kwara residents, mostly from Ilorin metropolis, including some PDP members, on Wednesday took to the streets to protest against what they described as "the political leadership of the Senate President, Dr. Bukola Saraki."

The protesters carried placards with various inscriptions condemning what they referred to as "bad governance," "political hegemony" and "under-development" under Saraki's political leadership.

The defecting Kwara PDP members also described Saraki as an "anathema.''

Chief Rex Olawoye, the Publicity Secretary of the party, made this known to the News Agency of Nigeria (NAN) in Ilorin.

"I hereby officially announce the exit of our members from PDP to APC," he said.

Olawoye, who described Senate President Bukola Saraki as an "anathema," said PDP members in the state could not work with him.

Olawoye said with the defection, all political structures of the PDP at the ward, local government and state levels had moved to the APC.

It could be recalled that yesterday, the Senate President Bukola Saraki and Governor Abdulfatah Ahmed, formerly members of the All Progressives Congress (APC), will be inheriting an empty house as they moved into the Kwara Peoples Democratic Party (PDP), as this has been perceived for a long time.

The spokesman appealed to all party members to maintain peace and orderliness in their conduct and behaviour.

"Unity is the primary ingredient that can make those of us coming from the PDP and leftover of APC members to live in harmony," he added.

He said Oyedepo had met with the leadership of the PDP in Abuja and explained the resolve of party members not to work with Saraki.

Olawoye also said the chairman met with the national leadership of APC, including the National Chairman, Adams Oshiomhole, Minister of Information and Culture, Alhaji Lai Mohammed, as well as other chieftains of the APC.

He added that the defecting PDP members were warmly welcomed into the APC by the party's leadership.

"Saraki and his cronies have been in the saddle of leadership of the state in the past 15 years with nothing to show for it,'' Olawoye stated.

Chief Rex Olawoye, therefore called on all registered political parties in the state to team up with the APC to ensure the total liberation of the state.

16 Oyo Lawmakers, Ladoja, Others Join ADC After Meeting With Obasanjo

Senator Rasidi Adewolu Ladoja, a former Governor of Oyo State, and some stalwarts of the Peoples Democtaric Party (PDP), in the state Wednesday morning met former President, Olusegun Obasanjo at his Abeokuta residence to perfect plans to join the African Democratic Congress (ADC), a party loyal to Chief Obasanjo.

According to the DAILY POST, Ladoja was accompanied to Obasanjo's residence by former Secretary to the State Government, Barrister Sarafadeen Alli and Public Relations Officer of PDP, Engineer Akeem Olatunji, Hon. Demola Omotoso and sixteen members of the state House of Assembly among whom were the Deputy Speaker, Hon. Musa Abdulwasiu and Hon. Muideen Olagunju.

Olatunji who confirmed that Ladoja and his lieutenants had agreed to dump the PDP at the meeting with Obasanjo, added that the leaders were on their way to Ibadan, the state capital to inform their loyalists about the new development.


The former PDP spokesman in a brief telephone conversation with DAILY POST Wednesday afternoon said, "Just had a marathon meeting with former President, Olusegun Obasanjo at Olusegun Obasanjo Presidential Library in Abeokuta."
He said that at the meeting were "Ex-President Olusegun Obasanjo, Senator Adewolu Ladoja, Prince Olagunsoye Oyinlola, Chief Michael Koleosho, Dr Busari Adebisi and Bar Sharafadeen Abiodun Alli.
Others according to him were, " Senator Monsurat Sunmonu, Chief Olayiwola Olakojo, Oyo State Labour Party Chairman, Hon Eriba, Engr Akeem Olatunji, Hon Ademola Kamil Omotoso, 16 members of Oyo State House of Assembly – among whom are the Deputy Speaker, Bar Wasiu, Hon Muideen Olalekan Olagunju and Hon. Adesina Adeniyi.
"ADC 8 members Caretaker committee to be inaugurated tomorrow by 1pm in Ibadan," he said.

Senator Shehu Sani Shows Buhari's Administration How To Treat APC Defectors

Senator Shehu Sani, Senator representing APC, Kaduna Central, has advised the Federal Government on how defectors from the ruling All Progressives Congress (APC) should be treated.

The Senator made this known via his Facebook page in the early hours of Wednesday to buttress the need for both the ruling party and the opposition party to maintain a harmonious relationship.

Read the Senators advice below:

"In view of the current reality, It's possible to have a harmonious working relationship between the parliament led by the opposition, and the presidency led by the ruling party, in the remaining lifespan of this political dispensation, if the following rules are kept by both sides.

1. Both sides must put the interest of the country first.

2. The Executive should respect the decision of those who chose to defect, maintain a cordial relationship with them and never attempt to persecute any of them for their individual political decisions.

3. The Parliament led by the opposition must not be a stumbling block for Government policies and programmes and the person of the president and his office must be accorded the highest respect it deserves.

4. All Inflammatory statements and plots from both sides must cease.

5. Both sides should be committed to working towards addressing the nation's chronic security challenges and the success of the upcoming national elections."

Mr Sani was amongst those expected to join a wave of defection that hit the APC last week, having made several categorical statements that suggested the move was imminent.

At least 14 senators and 37 House of Representatives announced their exit from the APC at the parliament last week. While most of those who severed ties with the ruling party joined the PDP, Nigeria's main opposition entity, at least one senator and four House members moved to other political parties, especially the African Democratic Congress.

On Tuesday, the Senate President, Bukola Saraki, made a formal announcement of his exit from the APC to join the PDP. In a statement he later released, he accused influential persons of the APC of intolerance and causing his exit.

"While I take full responsibility for this decision, I will like to emphasise that it is a decision that has been inescapably imposed on me by certain elements and forces within the APC who have ensured that the minimum conditions for peace, cooperation, inclusion and a general sense of belonging did not exist," he said.

While some other senators who were expected to decamp also failed to do so on Tuesday, it was Mr Sani's non-defection that drew the most insinuations from Nigerians.

Mr Sani later told PREMIUM TIMES that ex-Kaduna governor Balarabe Musa, APC National Chairman Adams Oshiomhole and party leader, Bola Tinubu, were among those who persuaded him not to leave the APC for the main opposition party, PDP.

Mr Sani's confrontation with his state governor, Nasir El-Rufai, is one of the most virulent rivalry in this political dispensation despite both men belonging to the APC.

The politicians snapped at each other shortly after settling down in their respective offices after their 2015 election.

Orji Kalu’s No-Case Submission Over N7.6bn Fraud Thrown-out By Judge

The former governor of Abia State, Chief Uzor Orji Kalu, who is facing a case of fraud at the Federal High Court in Lagos filed a no-case submission in response to the N7.6bn fraud charges brought against him by the Economic and Financial Crimes Commission and the presiding Judge threw out the no case submission.

The Judge, Justice Mohammed Idris, in his verdict, said Kalu had some explanations to make particularly on certain documents tendered by the EFCC as exhibits in evidence against him.

The ex-governor is facing 39 counts alongside his company, Slok Nigeria Limited; and Ude Udeogu, who served under him as the Director of Finance and Accounts at the Abia State Government House.

It could be recalled that the EFCC first arraigned them before Justice Idris on October 31, 2016.

They pleaded not guilty to the charges, following which the EFCC opened its case, calling 19 witnesses and tendering a load of exhibits.

At the conclusion of the prosecution's case, however, the defendants filed no-case submission, arguing that the EFCC failed to link them to any crime.

They urged Justice Idris to dismiss the charges and set them free.

However, the presiding Judge, however, disagreed with them in his yesterday's ruling, holding that they had explanations to make.

The Judge said: "I am of the view that the defendants have some explanations to make in the light of the exhibits and the evidence so far led. Again, I will say no more. The no-case submission is dismissed."

He called on the defendants to open their defence, reminding the parties that he had September ending deadline to finish the case.

Kalu's lawyer, Mr Gordy Uche (SAN), however, pleaded with the judge for a six-week adjournment to enable Kalu to go for a surgical operation.

"The first defendant has a medical appointment for surgery and the lead counsel in this matter had actually written a letter he wants us to bring to the attention of Your Lordship with respect to the surgery," Uche said.

He pleaded with the Judge to adjourn the case till September 10, 2018.

In a short ruling, Justice Idris said he was constrained to grant Uche's request, thereby adjourning the case to September 10 for the defendants to open their defence.

Senate President, Bukola Saraki Silent Over Position After Dumping APC For PDP

Dr. Bukola Saraki, Nigeria's Senate President, may likely lose his position in the Red Chamber, after defecting from the ruling All Progressives Congress (APC) to the People's Democratic Party (PDP) on Tuesday.

Recall that Saraki and 10 other Senators had joined the party in January 2014 from the PDP, and he emerged the Senate President in June 2015, following the success of the APC at the general elections.

However, Saraki emerged the Senate President against the wishes of the APC leadership, which favoured Ahmed Lawan, the current senate leader.

In the interim, he remains the Senate President, while we await the resumption of the Upper Chamber from recess in September, so as to ascertain who is now the majority between APC and the PDP in the Senate.

However, an argument in favour of Saraki, is the Section 50 (2) of the Constitution which says "The President or Deputy President of the Senate or the Speaker or Deputy Speaker of the House of Representatives shall vacate his office:

"a) If he ceases to be a member of the Senate or of the House of Representatives, as the case maybe, otherwise than by reason of a dissolution of the Senate or the House of Representatives; or

"b) When the House of which he was a member first sits after any dissolution of that House; or

"c) If removed from office by a resolution of the Senate or the House of Representatives, as the case may be, by the votes of not less than two-thirds majority of the members of the House."

DEFECTORS ARE TOO CLEVER BY HALF

President Muhammadu Buhari has been advised to ignore those who recently defected from the ruling party to other political parties. The Muslim Rights Concern (MURIC) gave this advice in a press statement issued on Monday.

According to the Islamic human rights organization, instead of dissipating energy on defectors, the Federal Government (FG) should concentrate on its infrastructural projects. The statement added that the defectors never really belonged to the ruling party. It described them as distractors who only possess nuisance value and politicians who find it difficult to operate in a transparent political environment because the corruption virus is not only in their blood, it is domiciled in their DNA.

"They have found an easy solution by defecting to the same party which prioritized corruption, idolized kleptomaniacs and rewarded criminality and impunity. These are the true enemies of the Nigerian people. Thieves are regrouping to loot again. We must congratulate Buhari for ridding his team of molls, pests, hypocrites and parasites. Majority of political liabilities and cogs in the wheel of progress are out of the way. But it is not over until the two big masquerades unmask and jump the fence into the traitors' mafia camp.

"We voted for these defectors because of Buhari. We did not vote for them on personal merit. We pity the defectors. They are victims of collective amnesia. Have they forgotten that they rode on the back of Buhari in 2015 to get into what later turned out to be a den of thieves? Buhari was the magic name in 2015. He has not lost that magnetic aura. The records show that he has performed creditably well in spite of the deadly mines laid by traitors in that notorious den. Buhari is still the dot in the com".

The signatory to the press release, Ishaq Akintola, a professor of Islamic eschatology said, "We are not moved by the number of defectors. The questions we should be asking is 'What is their quality? How much moral fiber do they possess? What has been their contribution to party followership? How loyal have they been to their party? Have they ever been supportive of presidential initiatives? Are they the type that will pass the integrity test? Have they been playing positive roles in the war against corruption?

"Progressives who support President Buhari's anti-graft fight should heave sighs of relief if the answers to the above questions are all negative. In fact Mr. President should be congratulated that traitors and clogs in the wheel of progress have finally shown their faces. When the going was good, they were only good as alternatives to Nollywood, court jesters and boot-lickers of corrupt hill-top political godfathers, sleeping on duty, blocking presidential nominees, budget padding and delaying budgets for seven months. These people never really belonged ab initio. They came with a mission to protect their stolen booty and to protect their superrich and corrupt godfathers by debilitating and retarding the war against corruption.

"What exactly is the benefit of bitter kola since it has no segments when cracked open and it is so bitter when bitten?  Wheat must be separated from the chaff before it can be useful and a good surgeon will not hesitate to amputate a rotten limb in order to save the remaining healthy part of the anatomy.

"We are aware of the fact that politicians generally have not lived up to the expection of Nigerians and no single political party is an exception. While there is little choice in rotten apples, we must note that if Buhari's party is not the answer, it cannot be those who pauperized the citizenry and brought the country to its knees. We are not thinking of any party, our focus is on President Muhammadu Buhari. Our interest is integrity, transparency, probity and accountability.

Nigerians are advised to jettison party politicking for that individual who has been identified as the champion of anti-corruption not only on the African continent but also in the whole world. We must build upon the recent singular honour which the International Criminal Court at the Hagues gave the Nigerian president when he was invited as an august visitor to the highly reputable court.

The significance of that invitation must not be lost on Nigerians. One of the judges of the court remarked that Buhari was the only African head of state to have visited the court as a guest and not as a criminal. We see this as a great honour to the whole country and not for our President alone. Therefore we have no single modicum of doubt that Buhari can lead Nigeria back to a glorious El Dorado if given the chance.

In our closing remarks, we urge President Muhammadu Buhari to ignore defectors and concentrate on infrastructural development. We urge Nigerians not to fall for the antics of dexterous kleptomaniacs. Let us rally behind President Muhammadu Buhari, Nigeria's only internationally acclaimed anti-graft crusader. Defectors from the ruling party have only exposed their true mission in politics, namely, stealing without borders. They jumped the boat when their mission failed. They have been too clever by half.
