Charlyboy, Protesters Storm US Embassy Over Buhari’s Suspension Of CJN Onnoghen

CharlyBoy and Civil Society leaders at US Embassy, Abuja
Hundreds of civil society leaders, lawyers and opposition politicians stormed the United States, U.S. embassy in Abuja on Saturday.

The protesters demanded that the U.S intervene in the "constitutional crisis" ignited by President Muhammadu Buhari with the suspension of Walter Onnoghen as Chief Justice of Nigeria.

Already, the president has appointed Justice Tanko Muhammad as the acting CJN.

The protesters, who where jointly led by CUPP spokesman, Imo Ugochinyere, Comrade Ariyo and Charlyboy, vowed to continue sitting at the embassy until tangible response comes out of their demand.

The group called on the NBA to announce total shut down on Monday and ban any lawyer from appearing or recognizing Muhammed, Daily Post reports.

Meanwhile, Muhammad, has urged the 250 appointed Chairmen and members of the Election Petition Tribunals to be guided by the fear of God in the performance of their duties.

The acting CJN stated this on Saturday in Abuja during the oath taking and swearing in ceremony of judicial officers appointed to oversee disputes arising from the forthcoming general elections.

"I am delighted to address you all on this occasion of the swearing-in ceremony for the newly appointed Chairmen and members of Election Petition Tribunals for the 2019 General Elections that is around the corner.

"As you lordships take the oath of office as chairmen and members of the Election Petition Tribunals, let me remind you that this oath is a solemn appeal to Almighty God.

"Therefore, it is God Almighty that you will be ultimately responsible to.

"Therefore, it is from this oath that your duties and responsibilities as chairmen and members of the Election Petition Tribunals in your various places of assignment spring forth and has a binding effect.

"This is an ethical undertaking to justice as well as upholding the rule of law in our courts.

"As such, I implore you to discharge your onerous duty diligently and with the fear of God Almighty,'' he said.

Muhammad also said: "the judiciary is in the trying time, you must stand to protect and uphold the integrity of this arm of government''.

"I therefore congratulate you on this appointment and I urge you to see this assignment as a call to greater service to your nation.

"I encourage you to uphold and enhance the honour and standing of the judiciary and I pray that the Almighty God will bestow upon you strength, good health and wisdom in the performance of your duties'', Muhammad said.

See What Woman Did In Order To Keep Her Marriage In Nasarawa, Buries Only Son Alive

Posted: 26 Jan 2019 04:26 PM PST

It is said that blood is thicker than water. But definitely, not so with Mrs. Mary Nyikwase Kyokwagh, who had to bury alive his two-months-old son, Aondona, her only son for that matter, in an attempt to save her marriage. No fiction could be stranger than that. But this is no fiction. This is real.

The woman, an indigene of Kuji village in Keana Local Government Area of Nasarawa State is married to Mr. Kenneth Azo Kyokwagh, from Taraba State. Sources say he left his village in Taraba to settle in Yarawatter, a village settlement in Guma Local Government Area of Benue State, that shares a common boundary with some villages in Nasarawa State.

Kyokwagh who spent years farming and fishing by way of subsistent living met Mary in a market square and hit it off immediately with her. The romantic relationship later led to marriage in February 2014. But they were to spend about four years without a child they could call their own though they loved each other. Unfortunately, the idea of medical test and solution never came up while the challenge lasted.

The herdsmen's attack that scattered life

It was in the midst of this problem that Mary went to the market to sell fish, leaving her husband at home, sometime in October 2017. While there, Fulani herdsmen attacked the village and killed a lot of people, displacing the entire area including the market place. People ran helter skelter for their lives. The crisis escalated and lasted till 2018. In the process, husband and wife lost total contact with each other and had some difficulties reconnecting, despite spirited efforts.

In the meantime, the entire village, was razed to the ground by the marauding herdsmen. Mary, believing that her husband had been killed, like others were, found her way to Kardoko IDP camp in Nasarawa State. While there, she couldn't cope with the emotional trauma that thoughts about her husband and the hard and difficult condition in the camp were causing her. In fact, hunger and lack of basic necessities of life were the order of the day in the camp.

A 'benefactor' adds his own sorrow to the story

It was in this condition that Dominic Akelegu, a Migili man by tribe, offered to assist her when he visited the camp. She obliged and left the camp to co-habit with him in his house, a rented apartment, in Lafia. When Kenneth Kyokwagh too could not trace his wife due to the constant attacks, he equally assumed that she had been killed. Lonely and distressed, he moved to Daudu IDP Camp in Guma Local Government Area of Benue State. While there, he also found out that he could not cope with the situation in the camp and decided along with other able-bodied young men to move to Lokoja, Kogi State, in search of greener pastures.

According to Mary, one thing led to another and, Dominic Akelegu, 40, her supposed magnanimous benefactor, started making love to her the moment she moved in with him. Barely two months later she became pregnant for him. Unfortunately, tragedy struck again as the man who is said to be an Okada rider in Lafia town died in fatal auto accident when her pregnancy was eight months and two weeks old. Before that time they had spent about 10 months together. But during this period, the idea of finding out Akelegu's birthplace never crossed Mary's mind. Neither did it occur to her to ask the man who accommodated and fed her.

In October 2018, she managed through the little savings he left behind for her and some financial assistance from neighbours to be delivered of a baby boy. But thereafter, life became tough for her and the newborn baby, as she could not cope with the difficulties of nursing him without his father. And to make a bad situation worse, she had nowhere to go as her own parents were killed in the attacks on farmers in Keana Local Government.

The painful meeting after long time of separation

But as the crisis subsided, Kenneth Kyokwagh, who she originally presumed dead suddenly re-appeared in December 2018 to start rebuilding his destroyed house in order to continue with what was left of his life. Earlier this January, 2019, his wife whom he also assumed dead in the attacks, feeling the ever increasing heat of frustration that comes with taking care of the newborn baby boy in Lafia, without anybody to help, decided to return to her husband's house in Tse-angom village near Yarwatter to start a new life with returning natives.

But to her greatest surprise, she met her husband alive and well. In fact, he has put one of the houses in order and was working on others. Naturally, the man was shocked to see his wife with a newborn baby – a baby he never knew anything about, of how she got it. For that, he vowed never to accept her under his roof, no matter what. His opposition to Mary to find somewhere to live with the child as he would, under no circumstance accept their living together really put her under great pressure, distress and confusion from which she did not know what else to do. In an effort to save her marriage since there is no other place to go, the woman decided to bury the boy alive while her husband was away in Lokoja to recover some of the debts being owed him by people he worked for. He returned from the one-week trip to discover to his horror and dismay that his wife had committed what seemed to him a greater atrocity by burying the baby boy alive.

Couple relives painful moments

Our correspondent who visited the village, which is about 282 kilometres from Lafia had interactions with both the man and his wife over the devilish act. Shaking his head severally, Kenneth Kyolawagh clapped his hands together, looked into the reporter's eyes and said: "This world is really a wicked place. I can't believe that this is happening to me. You can see that the village is very scanty. I don't know the whereabouts of other members of this village. Half of them were killed by the herdsmen, without their corpses being recovered. And the manner the attacks came, my wife was not at home and I thought she was affected on her way back; some of us ran for our lives.

"I managed to escape by God's grace. I completely believed she was killed like many others were. I found my way to Daudu and from there proceeded to Kogi State where most of our people were running to for greener pasture. I didn't hear from her. My anger is that within a year-plus, it was comfortable for her to re-marry; it means she didn't have me in mind. I am not ready to listen to her stories and how it happened. I can't accept her with a baby of somebody whose blood I don't know. It is not possible."

Asked if he can really exonerate himself from the crime as his hard, unyielding stance seemed to have pushed his wife into committing the ungodly act, he replied: "I didn't ask her to kill or bury the boy alive. I simply told her it will not be possible for us to stay together again with a baby not from me. I have suffered much in my life, especially in Kogi State which is why I returned despite the risk. I went back to recover my money from some people whom I worked for, only for me to come back and discover that she had done away with the boy to remain with me. I am speechless."

With tears streaming down her cheeks, his wife said: "I thought he had died in the attacks. I didn't know he is alive. I was frustrated and the man offered to help me out and suddenly started sleeping with me. He died eventually and my condition worsened at the time I thought I had gotten a safe landing. I had serious issues giving birth while I was with Mr. Kyokwagh. I didn't know I would meet him here again because I concluded he had died. I didn't hear from him and nobody seemed to know much about his whereabouts. Many villagers here died without their corpses recovered and I thought he was among them. Little did I know that he survived the attacks. He was not even ready to hear my explanation. Since he doesn't like seeing the newborn boy, I decided to bury him alive so that he can accept me back. Since few weeks that I returned here, he doesn't care about me and the baby simply because he is not the biological father. I decided to end his life in order to stay here. The biological father is late and I don't know how to trace his birthplace."

Asked if she regrets her action, she said that she would only do so if her husband fails to forgive her and accept her back. But what if, despite doing away with her baby, the man still insists she should find her way, what would she do? "I have nowhere to go," she said with an emotion-laden voice. "My parents were wiped away in the herdsmen attacks. The father of the boy who should have been alive to take care of me is gone. So this is my challenge."

Justice Onnoghen: US Embassy Speaks On The Suspension And Replacement Of Chief Justice Of Nigeria

Posted: 26 Jan 2019 03:34 PM PST

The Embassy of the United States

"The Embassy of the United States is deeply concerned by the impact of the executive branch's decision to suspend and replace the Chief Justice and head of the judicial branch without the support of the legislative branch on the eve of national and state elections.

We note widespread Nigerian criticism that this decision is unconstitutional and that it undermines the independence of the judicial branch. That undercuts the stated determination of government, candidates, and political party leaders to ensure that the elections proceed in a way that is free, fair, transparent, and peaceful – leading to a credible result.

We urge that the issues raised by this decision be resolved swiftly and peacefully in accordance with due process, full respect for the rule of law, and the spirit of the Constitution of Nigeria. Such action is needed urgently now to ensure that this decision does not cast a pall over the electoral process."

Femi Falana Speaks On Suspension Of CJN Onnoghen

Posted: 26 Jan 2019 02:24 PM PST

Femi Falana, SAN

Femi Falana, SAN, human rights lawyer, has finally lent his voice to the suspension of the Chief Justice of Nigeria, Justice Walter Onnoghen by President Muhammadu Buhari.

In a statement made available to newsmen, Mr. Falana stated that the Illegality of the suspension should not be allowed to stand.

In his words:

"I have had cause to call on the Attorney-General of the Federation, Mr. Abubakar Malami SAN to withdraw the charge of false declaration of assets filed against the Chief Justice of Nigeria, Justice Walter Onnoghen at the Code of Conduct Tribunal. The call was without prejudice to the merit of the serious allegations levelled against the Chief Justice. In line with decided judicial authorities I had wanted the National Judicial Council to investigate the allegations. Unfortunately, the 88th statutory meeting of the NJC scheduled to hold on January 15, 2019 which could have deliberated on the matter and take an informed position was postponed indefinitely on the directive of the embattled Chief Justice."

"As the battle shifted to the courts, both the Judiciary and the Executive were forum shopping for court orders from the Federal High Court, the National Industrial Court, the Code of Conduct Tribunal and the Court of Appeal. In the process, settled principles of law were sacrificed for the exigency of the moment."

"Thus, at the 15th annual Gani Fawehinmi lecture which held in Lagos on January 15 2019, I was compelled to warn against the dangerous trend. Regrettably, the warning fell on deaf ears. Curiously, in an act of brazen impunity, the Executive procured an ex parte order from the Code of Conduct Tribunal for the immediate suspension of the Chief Justice from office. In his purported compliance with the ex parte order, President Mohammadu Buhari has announced the suspension of Justice Onnoghen as the Chief Justice and appointed Justice Tanko Mohammad as the Acting Chief Justice."

"It is unfortunate that the Bar and the Bench have played into the hands of the sponsors of incipient fascism in the country. For reasons best known to them, the stakeholders in the legal profession stood by and allowed the Office of the Chief Justice to be completely desecrated. It is intringing that the 12 lawyers including three Senior Advocates of Nigeria in the federal cabinet did not deem it fit to disuade President Buhari from carrying out the illegal suspension of the Chief Justice on the basis of an ex parte order issued by the Code of Conduct Tribunal. In particular, they ought to have reminded the President of the compulsory retirement of Justice Stanley Nnaji and Justice Wilson Egbo-Egbo for issuing illegal ex parte orders for the removal of Dr. Chris Ngige as Governor of Anambra State. It is sad to recall that it was the federal government superintended by former President Olusegun Obasanjo that instigated the illegal removal of the governor at the material time."

"However, notwithstanding the inauguration of Justice Tanko Mohammad as the Acting Chief Justice the legal profession should not hesitate to review the entire Onnoghen saga in the interest of the nation's judiciary. In Elelu-Habeeb v AGF (2012) 40 WRN 1, the Supreme Court held that by virtue of section 292 of the Constitution the heads of the judicial arms of the state and federal governments in the country cannot be removed without a prior investigation conducted by the NJC. Consequently, the apex court set aside the purported removal of the appellant as the Chief judge of Kwara State upon an address forwarded to the house of assembly by former Governor Bukola Saraki. Therefore, the National Judicial Council should convene and constitute a committee to investigate the allegations leveled against the Chief Justice and make appropriate recommendation to the relevant authorities."

"Meanwhile, the legal team of the Chief Justice should proceed to challenge his suspension from office either at the Code of Conduct Tribunal or the Court of Appeal."

"Despite the gravity of the allegations levelled against the Chief Justice, the illegality of the suspension should not be allowed to stand. The ex parte order is a suspect document as the motion ex parte on which it was predicated was allegedly filed on January 9, 2019 while the substantive charge against the Chief Justice was filed at the registry of the Code of Conduct Tribunal on January 11, 2019. Furthermore, the counsel who argued the motion is not indicated in the ex parte order. However, in view of President Buhari's belated fidelity in the rule of law the federal government should comply with all valid and subsisting orders of competent municipal and regional courts made against the federal government. President Buhari should not be permitted to choose and pick orders of courts to obey."

Onnoghen Suspension: Our Democracy Is On Fire - House Of Reps Speaker, Dogara

Posted: 26 Jan 2019 02:05 PM PST

Hon. Yakubu Dogara
Hon. Yakubu Dogara the Speaker of House of Representatives, has weighed in on the recent suspension of the Chief Justice of Nigeria, Walter Nkanu Onnoghen by President Muhammadu Buhari.

The Speaker, in a statement made available to newsmen, raised alarm that Nigeria's democracy was 'on fire'.

"With the unconstitutional suspension of the Chief Justice of Nigeria (CJN) by President Muhammadu Buhari, the world has been served with notice that Nigeria is now a full-blown dictatorship. This did not come as a rude shock except to those that have been blind to the gradual but progressive erosion of democratic values in the polity as President Buhari's Government has never hidden its disdain for the rule of law."

"We have watched in disbelief as the Government recklessly deploys institutional prerogatives; routinely flouts the rule of law; subverts and assaults democratic Institutions; refuses to accept opponents as legitimate; suppresses citizens civil liberties(especially those of opponents) and trample underfoot the media. In short, the Government's tyrannical and authoritarian credentials are loathsomely legendary."

"No provision in Sections 157 and 292 of the 1999 Constitution as amended supports the President in purporting to suspend the CJN or swearing in an acting CJN. The whole idea of a limited government is that the President's powers is limited by law and it is ultra vires his powers to act in the absence of explicit legislative authorization. That is representative democracy at its best which our 1999 Constitution as amended guarantees."

"It is instructive to note that our Constitution does not contemplate or presupposes a situation whereby the Judiciary will have a suspended CJN and an acting CJN at the same time. Therefore, it is right to posit, as some have done that the President now has his own Chief Judge to do his bidding while Nigeria has a sitting CJN until he is removed in line with the provisions of the Constitution."

"The awfully crude annexation of the judiciary by the President in violation of his oath of office and the Constitution cannot be for any other reason except, as alleged by so many, to prepare the judiciary ahead of time for the purpose of conferring some aura of legitimacy to the contraption that the 2019 general elections may after all become."

"I therefore call on the President to remember that he has no better legacy to bequeath other than a good name: which cannot be achieved without honour, character and integrity. Honour and integrity demand that he upholds his oath of office by reversing this assault on our Constitution and following the manifestly clear and unambiguous constitutional procedure for the removal of the CJN if he must be removed. Anything short of this demeans all of us."

"To our citizens, we must now head the warning of the Irish lawyer cum orator, John Philpot Curran who said, "the condition upon which God had given liberty to man is eternal vigilance: which condition if he breaks, servitude is at once the consequences of his crime, and the punishment of his guilt". Despotism can only prosper in Nigeria if good men and women do nothing."

"I also call on all lovers of freedom and democracy all over the world to rise to the occasion and demand of this Government and the President to halt the march to anarchy and bedlam: which dictatorship promotes. The world has an experience in this and it must not allow this unmitigated disaster on Nigeria before it acts to restore sanity."

"As of today, Nigeria is now Germany in the wake of the 1933 Reichstag fire. Our democracy is on fire; ignited by the very people who swore to protect and defend it. That this fire must not convert the Chancellor to Fuhrer as it happened in Germany in 1933 depends on our collective response and that of the international community. We must not bow our knees to dictatorship: not now, not ever again."

JUST IN: We Are ‘Very Concerned’ Over CJN Onnoghen’s Suspension - European Union

Posted: 26 Jan 2019 02:58 PM PST

Justice Walter Onnoghen

The European Union has expressed deep concerns over the process and timing of the suspension of Justice Walter Onnoghen as Chief Justice of Nigeria.

The European Union Election Observation Mission on the Nigeria 2019 General Elections in a statement on Saturday by Press and Public Outreach Officer, Sarah Fradgley said the suspension raises the question of 'whether due process was followed'.

Recall that President Muhammadu Buhari suspended Onnoghen on Friday and appointed Justice Ibrahim Tanko Mohammed as CJN in Onnoghen's stead.

The EU calls on all parties to follow all legal processes in line with the constitution of the country, The Tribune Newspaper reports.

The statement read: "The European Union was invited by the Independent National Electoral Commission to observe the 2019 general elections.

"The EU Election Observation Mission (EU EOM) is very concerned about the process and timing of the suspension of the Chief Justice of Nigeria, Honourable Justice Walter Onnoghen, on 25 January.

"With 20 days until the presidential and National Assembly elections, political parties, candidates and voters must be able to have confidence in the impartiality and independence of the judicial system.

"The decision to suspend the Chief Justice has led to many Nigerians, including lawyers and civil society observer groups, to question whether due process was followed. The timing, just before the swearing in of justices for Electoral Tribunals and the hearing of election-related cases, has also raised concerns about the opportunity for electoral justice.

"The EU EOM calls on all parties to follow the legal processes provided for in the Constitution and to respond calmly to any concerns they may have.

"The EU EOM will continue observing all aspects of the election, including the independence of the election administration, the neutrality of security agencies, and the extent to which the judiciary can and does fulfil its election-related responsibilities."

2019 Election: PDP Suspended Presidential Campaign To 'save face' - Lai Mohammed

Posted: 26 Jan 2019 10:45 AM PST

Alhaji Lai Mohammed
The Minister of Information and Culture, Alhaji Lai Mohammed, has described as a face-saving measure the decision by the PDP to pull the brakes on its electioneering campaign over Justice Walter Onnoghen's suspension, saying the PDP's campaign never gained traction in the first instance.

Responding to reporters' question in Ilorin, the Kwara State capital, on Saturday, on the suspension of the PDP's campaign, the Minister said: ''Which Campaign? Their campaign was over a long time ago. There is nothing to suspend. We said it that their campaign had floundered. You can now see. What they are doing now is looking for a face-saving way out of a dead and buried campaign.''

He wondered why the PDP is crying more than the bereaved, and asked the opposition party whether Justice Onnoghen is one of its members.

"And in any event, let's ask them this question: Is there something that they know that we don't know? Is there something between them and the suspended CJN? Otherwise, we did not see why they should suspend their campaign anyway, but I can understand that their campaign was bound to end this way," Alhaji Mohammed said.

He said while Nigerians have been trooping out in large numbers wherever the President's campaign ship berths, the PDP supporters have been dwindling by the day.

On the outcry by some people and organizations over Justice Onnoghen's suspension, the Minister said it's troubling that those who are crying foul over the suspension of the CJN have actually ignored the fact that a serving Chief Justice not only amassed millions of dollars in his account, but admitted that he forgot to declare same in his Assets Declaration Form.

"For anybody who read Mr. President's address yesterday, two things stood out. The first is that additional evidence has just been revealed that the suspended CJN refused to declare millions of dollars in his possession. More worrisome is the fact that when the suspended CJN was confronted with the petition that he failed to declare his assets, he added that it was a mistake, that he forgot.

"Now, I would have been a happier person if the same people who are now crying tyranny and dictatorship could really address the issue raised by the President, in his address on Friday, that addition investigations have revealed that several millions of dollars were found in the CJN's account. And when the CJN was confronted with the original allegation, he admitted that he forgot to make full declaration, and that it was a mistake,'' he said.

On the constitutionality of the CJN's suspension, he faulted those claiming that the President acted outside of the Constitution, adding that in suspending Justice Onnoghen, the President merely carried out an order of a court of competent jurisdiction directing him to suspend the Chief Justice pending the final determination of the cases against him at the Code of Conduct Tribunal.

Justice Onnoghen: Ben Bruce Attacks Ezekwesili, You Contributed In Making Buhari A Tyrant

Posted: 26 Jan 2019 10:20 AM PST

Senator Ben Murray-Bruce
Senator Ben Murray-Bruce, the Senator representing Bayelsa East has attacked former Minister and ex-Presidential candidate, Oby Ezekwesili over her criticism of President Muhammadu Buhari on the recent suspension of the Chief Justice of Nigeria, Justice Walter Onnoghen.

Justice Onnoghen was suspended on Friday by President Muhammadu who said he acted on an order from the Code of Conduct Tribunal, CCT.

Ezekwesili in her reaction had called on Buhari to reverse what she described as a violation of the constitution.

However, Bruce in reaction warned Ezekwesili to stop 'shedding crocodile tears because she had fallen out with the President and save her tattered reputation.

According to him, Ezekwesili contributed to this development, adding that she once supported Buhari's fight against judiciary in 2016.

On his Twitter page, Bruce wrote: "Dear Ezekwesili, you supported Buhari when he started his war against the judiciary in 2016.

"On this same Twitter, I warned you and others like you that if you praised him then, you are only encouraging him to do worse. You contributed to this Oby.

"You clapped in 2016 when the war against the judiciary began. Today, because you have fallen out with the tyrant you are shedding crocodile tears?

"Have some decency and save what is left of your tattered reputation. People like you brought us to this point with your gullibility."

EFCC Urges Court To Throw Away Corruption Case Against Ex-Judge

Posted: 26 Jan 2019 10:13 AM PST

EFCC
The Economic and Financial Crimes Commission has urged a Lagos State High Court sitting in Ikeja to strike out the bribery charge against a former judge of the Federal High Court, Justice Rita Ofili-Ajumogobia.

Counsel for the EFCC, Rotimi Oyedepo, informed the court that the anti-graft agency had conceded that the court lacked jurisdiction based on the Appeal Court's decision in Justice Nganjuwa V. FRN.

Ofili-Ajumogobia, who is being tried for alleged bribery and unlawful enrichment, had challenged the jurisdiction of the court to hear her case.

She had argued through her lawyer, Chief Robert Clark (SAN), that the court had no power to hear the substantive case, Daily Post reports.

Where evidence has been adduced by the prosecution and they have closed their case, the consequential order to make as a result of jurisdiction is to discharge the accused whether on merit or simplicita.

"Where the question of jurisdiction is raised before the prosecution called witnesses, the court should discharge simplicita. Once the defendant is made to take a plea, the court must discharge him from the plea.

"However where the issue of jurisdiction has not been raised before the defendant has taken his plea and had allowed the defendant endure the strain of trial, the court should discharge the defendant.

"I urge the court to discharge and acquit the first defendant. According to Section 73(1) of the ACJL what has happened in this case is a withdrawal by agreeing My Lordship has no jurisdiction," Clarke said.

Ofili-Ajumogobia is standing trial alongside a Senior Advocate of Nigeria, Chief Godwin Obla, who was accused of bribing her with N5m.

Ifedayo Adedipe (SAN) the defence counsel to Mr. Godwin Obla (SAN), Ofili-Ajumogobia's co-defendant, urged the court to separate the joint charges of the defendants.

"Salvation in Christendom is individual, I submit that the second defendant (Obla) is not a judicial officer covered by the decision in Ngajuwa's case.

"I'm inviting Your Lordship to separate the first defendant from the second defendant.

"The subject matter is within the jurisdiction of the court and the second defendant is within the jurisdiction of the court. So the issue of jurisdiction does not apply to the second defendant," Adedipe said.

Justice Hakeem Oshodi adjourned the case until April 16 for ruling.

Justice Onnoghen: Third Force Gives Buhari 7 Days To Reverse Suspension, Threatens Mass Action

Posted: 26 Jan 2019 10:07 AM PST

President Muhammadu Buhari
The third force movement under the aegis of the Nigerian Intervention Movement, NIM, have given President Muhammadu Buhari seven days to reinstate the Chief Justice of Nigeria, Justice Walter Onnoghen.

The Third Force said failure to do this, the President will face unprecedented mass action.

NIM which is jointly led by legal icon, Dr Olisa Agbakoba, SAN, and Dr Tafawa Balewa said the suspension of the CJN and the swearing-in of Justice Tanko Ibrahim Mohammed was a threat to Nigeria's fledgeling democracy.

NIM said it was putting Buhari on a strong notice that at the end of seven days from Friday, if he fails to reinstate the CJN, they will be compelled to mobilise a coalition forces of Nigerian civil society and leaders of conscience across the country to confront the Buhari regime with an unprecedented mass action to save Nigeria's democracy, Daily Post reports.

It said, "A meeting of the coalition of forces against civilian dictatorship in Nigeria has been slated to hold on Thursday 31st January in Lagos to kick start a nationwide mobilisation to save democracy ahead of the 2019 elections.

In the statement signed by Debo Adeniyi, NIM's Director, Media Bureau, the Third Force added, "The third force movement under the auspices of Nigeria Intervention Movement, NIM have given President Muhammadu Buhari seven days to reinstate the Chief Justice of Nigeria, Justice Walter Onnoghen or face an unprecedented mass action from the third force movement and its allies until the President's unpopular decision is rescinded

"The NIM being jointly led by a frontline civil right activist and legal Icon, Dr Olisa Agbakoba SAN and the son of former prime minister of Nigeria, Dr Abduljalil Tafawa Balewa profoundly views the suspension of the CJN and the precipitate swearing in of the President's Kinsman, Justice Tanko Ibrahim Mohammed as a threat to Nigeria's fledgling democracy and the feasibility of the 2019 general elections as well a desperation to compromise all relevant Institutions of state ahead of the 2019 elections

"By this statement, we wish to put President Buhari on a strong notice that at the end of seven days from today, if President Buhari fails to reinstate the CJN we shall be compelled to mobilise a Coalition Forces of Nigerian Civil society and leaders of conscience across the country to confront the Buhari regime with an unprecedented mass action to save Nigeria's democracy

"We wish to assert that the action of the President today is subjudice, smacks of crass dictatorship and a setback for constitutional democracy in our country, just as it is a clear descent of civil rule to the dark days of military jackboot in Nigeria as recently alerted by former president, Olusegun Obasanjo and we in NIM, who fought with our lives to restore Nigeria's current democracy, have vowed to resist the dastardly move of the Buhari regime to cage all institutions of State ahead of the 2019 elections, with every resources at our disposal.

"The meeting of the coalition of forces against civilian dictatorship in Nigeria has been slated to hold on Thursday 31st January in Lagos to kick start a nationwide mobilisation to save democracy ahead of the 2019 elections."

Chief Dele Momodu and President Muhammadu Buhari
Chief Dele Momodu, Media Enterprenuer, has described the suspension of the Chief Justice of Nigeria, Justice Walter Onnoghen as "a war against opposition."

President Muhammadu Buhari had on Friday suspended Justice Onnoghen following an interim order by the Code of Conduct Tribunal (CCT) in favour of the Federal Government.

Mr. Ibrahim Tanko Mohammed was sworn-in as the acting CJN in his place.

Explaining his reason, the President said he suspended Justice Onnoghen, following an order from the Code of Conduct Tribunal, CCT, asking him to wield the big stick.

In a statement sent to DAILY POST, Buhari said the order demanded that the CJN be suspended pending the determination of his ongoing trial at the tribunal.

But, reacting to development, Dele Momodu on Twitter said the 'noise on the war against corruption should be changed to 'war against opposition.'

He said, "So every allegation should lead to resignation? What a smart way of eliminating perceived enemies; one of the reasons I respect SARAKI who defended himself like a man and shamed his tormentors.

"Walahi, the noise about war against corruption should be changed urgently to war against opposition.

"And protection of friends of ruling saints."
